Fair use is getting a lesson in compensation. Perplexity is launching a program to share ad revenue with publishing partners following weeks of plagiarism accusations. Under the program, when Perplexity features content from publishers including Fortune, Time and WordPress, these companies will receive a double-digit percentage of revenue share. Perplexity and OpenAI are dealing with publishers differently. Perplexity's program comes at a time when publishers and other content creators are pushing back on AI companies and their training models. For the past year, OpenAI has been developing licensing agreements with media outlets including The New York Times over compensation. But Perplexity's strategy is a bit more nuanced. In Perplexity's case, payments are made on a per-source basis, meaning publishers are compensated for each article used in responses. The program will temporarily provide cash advances on revenue to publishers as Perplexity builds a long-term advertising model. Unlike OpenAI's deals, the advances aren’t a licensing fee for content. This is only the beginning. Perplexity's program comes amid a rising conflict between AI startups and media outlets. While publishers are aggressively defending their content from misuse in AI-generated content, the same is true of other content creators including the music industry and book authors. So while OpenAI and Perplexity sign such deals, the reality is many more agreements and alliances are likely to come. There's also the smoke and mirrors argument. AI companies appear determined to utilize publishers' content regardless of consent or permission, putting the media industry in a precarious position. Many outlets are choosing to accept financial compensation rather than engage in expensive legal disputes. There is so much potential for AI to help address inequity. Wouldn’t it be cool if all that is needed is to set your preferred language in your browser just once and no matter what website you arrive at it is in your preferred language and you are confident in the translation. Is that already available? A lot going on this week with regards to AI and Publishing. Runway revelations and the (long anticipated) announcement of SearchGPT. If you'd like to read up on the publishing industry's relationship with AI, we wrote a mini-report on the topic back in April on how publishers can go about thriving in this new environment. "But what does this mean for news publishers? It depends. For larger organisations, it means harnessing their masses of high-quality data in ways that improve the user experience and building new services into their offering. At the same time, this means opening up new revenue streams for their business models through licensing."

And unique from other reports of its kind, this report is meant to be cross-functional - comparing Legal, Tax, Risk & Fraud and Government to determine how Gen AI has grown across professional services within the past 12 months. Some key stats are below, but the highlights: - People are feeling more confident about Gen AI than this time last year, though there remains some thoughtful hesitancy. - ChatGPT/public-facing tools are being used more right now, but industry-specific tools are expected to have a high growth rate. - Clients want their firms to use Gen AI, but they're not demanding it... yet. - Legal and Tax Firms somewhat conflict as to how Gen AI may affect their business models. - Not many are training specifically for Gen AI, but they think it could play an impact on job roles in the near future. And for me personally as the lead writer: This is the longest report I've written to date, and it took a lot of work to get here. In today's digital landscape, where content reigns supreme, ensuring fair treatment of creators is paramount. Canada did it, and now California wants to do it. Lawmakers are advancing a bill that would force Google and Meta to pay news publishers each time they display pieces of their articles or show links to them in search results or on social media. But it could also be a harbinger of the legal troubles lurking for AI companies. Let's face it. The journalism industry has been battered and decimated over the years by search engines, social media and in general, the internet which posts news articles from news outlets without providing any compensation. Canada's Online News Act essentially compelling companies including Google and Meta to pay Canadian news outlets if they host links to their content. For their part, Meta and Google threatened to remove news links for all Canadian users, permanently. And Canada isn't alone. Australia has a similar law, with governments in Britain, Brazil, Indonesia, New Zealand, South Africa and Switzerland are all considering similar legislation. What's noteworthy is the potential impact on the AI industry, which is facing similar copyright lawsuits and how AI models are trained. All the big generative AI models from every company are trained on huge swaths of data that are scraped from the entire internet. Major media organizations, including The New York Times and Getty Images, have sued AI companies alleging copyright infringement, claiming the AI companies are using their creative content without permission to generate profits. Though the situation search engines and AI companies are similar around the notion of fair use and compensation, the lawsuits against AI companies are much more significant since we're talking about all forms of content including books, music, and video among others. Given increasing fears that AI will take away jobs from humans, the role of content is amplified. So don't let the content compensation issue around search engines and social media fool you - the stakes are even higher for AI.
