Another insight from "Escaping the Housing Trap" "The missing middle has gone missing largely because of zoning." "...different elements of a zoning code tend to interact in complex ways to render development on a piece of land infeasible. By the time you have complied with building setback requirements (distance from the edges of the lot), height restrictions, floor area maximums, and added the mandatory number of parking stalls, there is often not enough room left on the lot to accommodate a viable multi-unit building." Here is a real world example. I looked a two lots recently in a municipality near me. They are located on a busy road with a mix of commercial and residential development. Both lots lots are 0.11 acres in size (0.22 total) and are the same size as about 30 single family lots on the same block that each have a home on them. Pretty much all of the homes on the busy road are now being used for commercial uses. Zoning allows for ONLY single family development (even though one of the lots has wide frontage on the busy road where everything else is commercial). The minimum lot size has grown from when the lots were originally subdivided and developed, so that not even a single-family home can be legally built on one of the lots (minimum lot size for a SF home is 0.138 acres). The city is adamant that they not be rezoned. The result? The only solution if you wanted to develop this property is to combine the lots into one lot that has frontage on a busy commercial road and is twice as big as the lots surrounding it, and build one single family home with an ADU. Madness.

In U.S. cities where missing middle housing is legal, zoning changes alone have not been enough to result in more of this housing type. Developers in cities where missing middle housing is legal have noted that building codes and design requirements are still barriers that have made these projects economically infeasible. Common setbacks include requirements for floor area ratios, height limitations, parking regulations, and permitting timelines. Another challenge is financing middle housing projects. National banks and sources of equity have not been immediately receptive to middle housing projects either because these projects are too small in volume to justify the transaction, or because these institutions view missing middle housing as risky due to the lack of scale. HUD released some very exciting updates to the "HUD code" today. notably, this revision creates a pathway to now build up to 4 unit HUD code homes (which, i believe, is the first time the U.S. has enabled a format of multifamily housing to be built under a national building code). lots of other exciting updates, but the newly opened pathway to enable up to 4 unit HUD code homes is a big step forward for manufactured homes to be applied to missing middle / small scale multifamily applications. big step forward and i'm really looking forward to seeing how manufacturers and builders (like Villa) will find creative applications for homes that can now be built under the revised code. https://lnkd.in/gJbqVK-A
