Pryor Cashman Partner Robert deBrauwere and Associate Scott Resnick co-authored a client alert detailing the recent amendments to the California Consumer Privacy Act (CCPA) signed into law by Governor Gavin Newsom on September 28, 2024. This US-style focus on billables marks a departure from the ‘no target-hours culture’ prevalent at many UK firms. Clyde & Co Boosts Revenue by 10%: Clyde & Co has reported strong financial results for the past year, with revenue growing by 10% to £845 million. Profit per equity partner (PEP) increased by 4% to £739,000. The firm attributed its growth to success across various practice areas, emphasizing its "sector-focused, geographically hedged" model. While this may seem like just another case against the SEC, Bitnomial, with its clean track record, seems to be in a unique position to advocate for a court ruling here that could have significant impacts to the industry. A favorable outcome would not only be another court bolstering Judge Torres' ruling regarding secondary sales, but potentially could extend far beyond that. Should the court rule in favor of Bitnomial, this could establish a precedent that clarifies regulatory jurisdiction within the digital asset derivative space. Such a ruling would confirm that the SEC lacks authority over crypto-based derivatives and, more crucially, affirm that the underlying assets are not classified as securities. Will be interesting to see how this one plays out.

New Ruling on Punitive Damages and Attorney Fees in California Invasion of Privacy Act (CIPA) Case As Thompson Hine has previously reported, the recent surge of privacy claims under the California Invasion of Privacy Act (CIPA) related to using website cookies, pixels, and web beacons continues to impact a several sectors. It has been especially harmful to small businesses. On July 15, Judge Rolf Treu ruled on a preliminary motion in a CIPA lawsuit and concluded that the plaintiff could potentially recover punitive damages and attorney fees. Although this case does not address the merits of whether website tracking technologies are considered pen registers or trap and trace devices under CIPA, plaintiffs may rely on it to demand larger awards and settlements in their CIPA actions. Businesses that deploy these types of online tracking technologies should immediately reassess the legal terms governing the use of their websites and whether they contain favorable dispute resolution provisions, such as remedies available for claims arising from a consumer’s use of the website. Andrew Maloney reports: Kirkland & Ellis has again reached the 200 mark in its latest round of partner promotions, though the total is slightly less than last year's size, making it the first time the class has decreased year-over-year in at least the last eight years. The highest-grossing firm in the world announced Tuesday that it was promoting exactly 200 attorneys to partner, effective Tuesday. That's down slightly from last year's total of 205, representing about a 2.4% drop. Kirkland announced 193 partners in 2022, 151 new partners in 2021, 145 in 2020, 141 in 2019, 122 in 2018, 97 in 2017 and 81 in 2016. For the new partner class this year, New York and California are the top locations, even with Kirkland having Chicago roots. (The firm continues to be the largest law firm in New York by attorney head count.) The firm announced 44 partners in New York, 38 in California (Los Angeles and the Bay Area), 34 in Texas, 26 in Chicago and 25 in London, among other locations. In their article on a recent ruling by the Appellate Division, Second Department in New York, WSHB partners Bolam Kim and Cole Munson reinforce the significance of timely claims. The case, Hillaire v. Jose A. Torres, involved a homeowner suing for breach of contract due to alleged construction defects in a basement remodel. The plaintiff claimed that the defendant improperly installed flooring in 2015. However, the lawsuit was filed nearly seven years after the completion of the work, surpassing New York's six-year statute of limitations for breach of contract. Consequently, the court deemed the complaint too late.
