**Bechara Beech Mein Phas Gaya** I am not an expert in law, and I don't know whether I am right or not, but this post is dedicated to the person who did nothing wrong but is going through tough times. Yes, the same Thar driver who was driving in the area where three UPSC aspirants died due to flooding. Suppose you are driving a car and you don't know what is happening around you. You are following all the procedures and rules, you have insurance and a driving license, and you are driving at a speed of 10 or 20 km/h in heavy rain. Because of the neglectful behavior of the coaching institution and the authorities, the glass of the coaching institution was broken by the waves of water generated from your car. Although it's not a crime, the court denies bail to you. After studying one year of law, I understand that in the commission of a crime, there are two essential elements: actus reus (guilty act) and mens rea (guilty mind). Here, there was neither a guilty act nor a guilty mind. What was he doing? He was just driving his car. It's the irresponsibility of the coaching institution, which is conducting classes in the basement (an illegal practice), and the authorities, who are always sleeping and only wake up when a tragedy happens. I believe court decisions are highly influenced by public outrage. The Thar driver was denied bail. Why? Bail is a right of every individual. We, as law students, choose this profession for those who cannot speak for themselves and to help those who are unable to help themselves. However, these types of news, where the court denies bail, really dishearten us. Think of Umar Khalid, Gulfisha Fatima, and Khalid Saifi, who are in jail without any proper trial, and now this Thar driver. Even after proving that this person is not responsible for the deaths of the three UPSC aspirants, maybe he will be acquitted from jail. But what about the years he spent in jail? Where is his right? Who is going to employ this person after this incident? How will society treat him? How is he going to live in society after this incident? I don't know whether all these points are relevant or not, but this is what a common person of this country is thinking. I don't understand why our so-called educated people are not understanding this. I hope that the Indian system will change, and they will start taking responsibility for the authorities rather than blaming an innocent person. #UPSC #BAILDENIED

Dying Declaration Introduction: The word dying declaration is derived from the word ‘leterm motem’ which means words said before death. It means the statement of the person who is dead explaining the cause of death. The term dying declaration has not been defined in the Indian Evidence Act 1872 but Section 32(1) of the Act contains provision in relation to dying declaration. Section 32(1) of IEA: This section states that when the statement is made by a person as to the cause of his death, or as to any of the circumstances of the transaction which resulted in his death, in cases in which the cause of that person's death comes into question. Such statements are relevant whether the person who made them was or was not, at the time when they were made, under expectation of death, and whatever may be the nature of the proceeding in which the cause of his death comes into question. Characteristics of Dying Declaration: Dying declaration is one of the exceptions of the rule of excluding hearsay evidence. It is not necessary that the dying declaration is relevant only in a particular kind of proceedings. The proceedings may be civil or criminal. There is no absolute rule of law that a dying declaration, unless corroborated by other independent evidence, is not fit to be acted upon. By Whom the Dying Declaration is Recorded: It is best that it is recorded by the magistrate. If there is no time to call the magistrate, keeping in view the deteriorating condition of the declaration, it can be recorded by anybody. It cannot be said that a dying declaration recorded by a police officer is always invalid. If any dying declaration is not recorded by the competent Magistrate, it is better that signatures of the witnesses are taken who are present at the time of recording it. Procedure for Recording Dying Declaration: Recording a dying declaration is not a prescribed procedure and is not limited to Magistrate. A narrative form may provide a more natural and accurate account of the incident. Case Law: In Khushal Rao v. State of Bombay (1958), the Supreme Court established principles regarding dying declarations. These principles include that a true and voluntary declaration requires no corroboration, is not weaker than other evidence, and must be determined on its own facts.     Venus has just entered Gemini ruled by Mercury, while Mercury is still in Taurus ruled by Venus. This means that Mercury and Gemini are exchanging signs, and the indications of these signs will be intertwined. This will only be for a brief period, as Mercury will enter Gemini within five days. The Sun is also in Taurus and will enter Gemini in two days. This will leave Jupiter alone in Taurus.      Mars has left its Gandanta or Drowning point this past week and is now transiting and active in its own sign of Aries. Saturn is aspecting this transit from its own sign of Aquarius. Rahu is placed between these two malefic planets in Jupiter ruled Pisces. Being placed between malefics usually brings out the worst in a planet and makes the experience of the planet intense and unpleasant. It is the planetary version of being between a rock and a hard place.       However, Saturn and Mars are both strong in their own houses and this usually brings good results, even from malefic planets, though it may feel bad. Rahu itself is malefic and is often responsible for sudden tragic events. This combination indicates a sudden loss, insight, or ending that may seem tragic and feel terrible, but which contains an unexpected or hidden boon within it. This boon would likely come in the form of fame, money, or some pleasure normally seen as forbidden. It could also indicate gaining the discipline and motivation to cut some habit or belief that is draining your energy out of your life.       The exchange of signs between Venus and Mercury also indicates wealth through communication, speculation, or a skill involving the voice or hands. There is also something dreamlike or illusory indicated by both Rahu and Pisces making this transit difficult to navigate and will be hardest for those with a natal Moon in Pisces.
