A recent proposal in bankruptcy court may allow J&J to settle serious claims related to ovarian cancer and mesothelioma at a fraction of their value. This move not only undermines justice for victims and their families but also risks setting a dangerous precedent. Clients to avoid: ▶ The Tire Kicker - never actually hires; just picks the attorney’s brain incessantly. “I just have one more question.”  To be avoided at all costs. ▶ The Bum-Rusher - hires you; then disappears for weeks or months on end, only to resurface at the last possible moment or when a critical deadline is about to drop.  ▶ The Micro-Manager / Helicopter-Client - has control / trust issues. Has to micro-manage every step of the case. Deep down, does not trust that any professional can handle their case properly. ▶ The Comparison-Shopper - has consulted with at least 5 other attorneys and hires the attorney who quotes them the lowest fee. ▶ The DIY'er - expects the attorney to teach client exactly how to file their case during the consultation, from soup to nuts. Bonus points: has already prepared all the immigration forms and expects attorney to review said forms during the consultation and give the attorney's "blessing" that they can file the application with USCIS / guarantee that nothing will go wrong. Don't get me wrong. I've been truly fortunate to work with clients who I genuinely like. But how many of us attorneys have been there? #kiddingnotkidding #immigration #immigrationlawyer #lawyerlife

With rare exceptions, you don't need to spend all day deposing the opposing party (the exceptions include a case where you have multiple defendants, and each needs to depose the plaintiff about their client). When preparing a deposition outline, yes, you should ask some discovery questions, but largely, you're asking questions to secure answers to use at trial. You are asking the questions to secure admissions or facts that you can then ask again at trial, and if given a different response, you can use the deposition to impeach. If that is the prism through which you prepare your deposition outlines, you will ask fewer, better, more practical questions.

Litigation train wrecks redux. Common elements distilled from a decade worth of lessons from dumpster fire non-compete / trade secret / unfair competition cases. 1. Corporate plaintiff represented by BIGLAW or larger MIDLAW. Check. 2. A bogus non-compete / trade secret / unfair competition claim. Weak on the merits but some bad facts. IE: Defendant or someone the defendant hired took some documents from Old Co but those documents are actually meaningless. Just smoke and bad optics. Check. 3. Defendant has some resources but has not reached a level of being legally sophisticated. IE no in-house legal team, weak in-house legal team, no knowledge / understanding of who to hire for the problem. Defendant is often cross-sold by their existing outside law firm. Their outside law firm does corporate paperwork and transactional stuff. When called about litigation, the outside firm says, yes, we do that too. Mismatch of skillset / lack of relevant expertise. Defendant's lawyers get in over their head. Check. 4. The no strategy defense strategy. The cry uncle defense. Agreeing to the plaintiff's outrageous demands to avoid, say, a big hearing or an ugly fight. Playing whack-a-mole. Capitulating and being purely reactive. Check. 5. Psychology and orientation. The plaintiff's original position was absurd. Basically: Give us $10 million -- you have no defenses! Rather than pushing back and forcing the corporate plaintiff off that position, the defense basically buys into that landscape as being a reasonable, quasi-reasonable, or realistic one. The signaling there is all wrong. Confirmation rather than re-setting the field and reorienting expectations. Check. 5. Discovery as a weapon. Defendant takes on excessive discovery obligations (back to the cry uncle / capitulation strategy). Defendant capitulates to unreasonable discovery demands. IE: We demand you collect every device in the whole company! You either know how to deal with hundreds of thousands of possible documents, hundreds of computers... phones.. servers... clouds-based platforms... and an overreaching corporate lawyer on the plaintiff side who is billing by the hours... or not. $500,000++ in unnecessary litigation spend on unnecessary discovery crusades. Check. 6. The case becomes entirely about discovery obligations. The merits fall by the wayside. Now, the case is all about how the defendant owes the plaintiff a billion documents. Sanctions. Contempt. Threats to strike pleadings based on alleged discovery abuses / deficiencies. That becomes the collapse play. Check. I've seen this movie 100 times. Don't mind me. Going for a low cost, DIY legal document provider is a recipe for future disaster. Legal documents are incredibly important. I also see lots of estate plans play out and legal documents alone are NOT enough to avoid a mess. I also see well crafted (and expensive) documents still not play out how they're supposed to. How much or little you spend is no guarantee of leaving a manageable legal to do list. If you are building wealth you need a plan that works for what your wealth should do when you can no longer control it. That's why having an estate plan that WORKS is so critical.
