Something I hear a lot from property owners in property tax mediations is... ... I brought this lawsuit because the appraisal district has increased the value of the property by a huge percentage over last year, with no change in the property, and nothing justifies the huge increase. There's no way the district can justifiably support the increase, so there's no way the district can win this lawsuit. There is a fundamental disconnect here. Property owners would benefit from better understanding what the lawsuit actually requires from the property owner. This recent case does a good job going back over the fundamentals of a property tax suit brought by the property owner. First, the lawsuit is a de novo appeal from the ARB/top-line. This means it's a complete do-over, and what happened at prior steps in the appeal process are not considered. Next, the Plaintiff has the burden of proof as to the property's value. Meaning, the Plaintiff has to offer admissible evidence proving the property's value on January 1 of the year(s) at issue. The district does not have to defend any increase in the property's value over a prior year. The judge, jury, or arbitrator (whoever is deciding the case - called "the fact finder") gets to assess the credibility of witnesses and weight to be given to any specific item of evidence. "The fact finder may believe one witness instead of another, accept or reject any given witness's testimony in whole or part, and resolve conflicts in the proof." Here, the property owner testified that there were no improvements made to the property after 12/31/2019. The district presented evidence of such improvements, including a construction change order indicating work would continue into January, 2020; a photograph consistent with the change order indicating work being done in January, 2020, and other testimony and evidence. The appeals court notes that despite it being the property owner's burden, the only evidence presented was the property owner's "own interested and non-specific testimony that it was finished by the end of the year. He did not present any objective evidence of a specific date, such as a payment draw schedule, a construction schedule, proof of the final draw payment on the construction loan, a punch list or its completion date, a copy of the contract he had with his builder, or photographs of the Property on January 1, 2020 (despite having taken multiple photographs throughout the project, including the January 8, 2020 one with the drop cloths)." One of the things I do in mediation is take a look at each side's case. Who appears to be more persuasive? Who has more risk? Is the trial court likely to be the finish line - or should each side consider the time and cost of an appeal in its analysis?
