I've had some conversations lately about how an LLC in Texas (and probably elsewhere) can be useful for protecting a single real estate asset in a rental portfolio. Why do I know this? I know this because I spent a good part of my career helping lenders and mortgage loan servicers rehabilitate valid liens that were stripped from properties through trickery and wrongfully taken default judgments. A very common strategy of the wrongdoers was to take ownership of a borrower's property and hold it in a single-asset LLC while my clients used the legal process to rehabilitate their lien. As the process plays out the fraudsters collect from the borrower, maybe a renter, or unsuspecting buyers all while the mortgage is going unpaid. Once the lien is rehabilitated everyone except the fraudsters are left holding the bag and rarely anything can be collected from the LLC that held the property asset. That doesn't mean an LLC in Texas is a bad thing. It just shows a good legal tool doing its job, but in the wrong hands. In the right hands a Texas LLC is a great way to protect a real estate asset and limit personal liability related to a rental property (or maybe a flip). But know, there are some considerations to think about before randomly executing deeds to an LLC. I'd love to hear from anyone here (or reach out directly) that wants to discuss. Another win for employers as the Biden-Harris FTC non-compete rule is enjoined nationwide as unconstitutional! Employers, you should hire firms like mine who have advocated from the beginning that this rule is overbroad and unlawful. Be extremely wary of lawyers and law firms who have relied upon this Biden-Harris FTC rule to try to invalidate otherwise enforceable non-compete agreements.

It's pretty common for me to work with other agents to help their clients with a legal issue. For example, if an agent or client is worried about a lease, then I advise and make sure things are done right to remedy and prevent problems. A lot of the issues involve the relevant contracts. Other issues are related to financing, including creative financing. Boundary disputes. How to structure a lease or agreements creatively. It's fun to be involved with the trickier transactions that require a little extra.
