Great post. Ask yourself, “Does this activity protect the worker?” If so, it’s an OHS requirement. Ask yourself, “Does this activity protect the public, environment, and/or infrastructure?” If so, it’s an NSC requirement. If your answer is, “Well it’s both.”, then awesome job. You’re right. It belongs in your company’s health & safety management system. You’re managing HAZARDS. They do not change just because it’s a different set of requirements. What is different is you are using ALL your tools in your toolbox and approaching safety from a holistic perspective.

DOT Compliance Safety Association presents: It's NOT Always about Trucking... DOT Regulations may, can be and are applicable to Landscapers, Plumbing, Construction, etc. Yes, as a former DOT Investigator I did a Federal Compliance Review on a Landscaper driving and F-250 pulling a trailer that made his operations Applicable to DOT Regulations. I get this question MUCH too often, it's apparent to me that I can stand by a Major Intersection and SEE 100s of non-compliant Drivers and Vehicles crossing without DOT numbers.... which more than likely means that company has ZERO DOT Compliance. Yes, Prime Nuclear Verdicts in the event of an Accident through Litigation and Heavy Enforcement from State and Federal DOT Authorities... Question- I have a Company that employees Drivers operating Vehicles... How are DOT Regulations Applicable to Me? Regulations DOT proposal aims to simplifying hazmat regs CCJ Staff Oct 7, 2024 The U.S. Department of Transportation’s (DOT) Pipeline and Hazardous Materials Safety Administration (PHMSA) Monday announced a new proposed rule the agency said will provide close to $100 million in annual cost savings for businesses and consumers. The proposed rule updates and modernizes regulations to accommodate the latest technologies, business practices, and understandings of hazardous materials, including updates in packaging practices for hazmat transportation. Further, PHMSA said it reduces burdens for U.S. truck drivers by simplifying hazard communication requirements for fuels including gasoline that are transported in tanker trucks; encourages innovation and safety improvements to hazardous materials rail cars by reducing review times for tank car design improvements and addressing National Transportation Safety Board recommendations regarding improved design standards for rail tank cars; and modernizes standards for essential agricultural equipment by codifying manufacturing standards for newly built fertilizer tanks and permitting the use of video and fiber optics technologies when inspecting and calibrating cargo tanks in both agricultural and non-agricultural operations.  https://lnkd.in/g6CNCTni?

Regulations FMCSA plows ahead with changes to Crash Preventability Determination Program Matt Cole Dec 4, 2024 "New crash types The agency also proposed to add four new crash types: 1. CMV was struck on the side by a motorist operating in the same direction. 2. CMV was struck because another motorist was entering the roadway from a private driveway or parking lot. 3. CMV was struck because another motorist lost control of their vehicle. The Police Accident Report (PAR) must specifically mention loss of control either in the citation, contributing factors, and/or PAR narrative. 4. Federal regulators plan to survey truck drivers on their seat belt habits after recent fatality data revealed a high number of unrestrained drivers involved in fatal accidents. CVSA Brake Check week The annual CVSA Brake Check week will be from 8/25-8/31. This is the CVSA’s push to make sure that brakes are working properly, the CVSA plans on inspecting 5000,000 trucks in 7 days. The CVSA wants to see increased numbers of inspections as well as an increased number of trucks being reviewed, if you are pulled into a weigh station and they see your disk brakes, you can rest assured that the DOT officer or Trooper will take the time to review your logs and they will probably give you a level 2, rather than a level 1. It is imperative that you make sure that you have attached the proper tanker and entered in the correct BOL number every time you change tankers, or pick up a new load. That is not to say that they will not conduct a level 1, but more than likely a level 2. Since Brake Check starts on Sunday 8/25, if the Inspector or trooper decides to review your logs he/she can look back 8 days to August 17th. This means that starting next Saturday your logs will need to be perfect till the end of the month. Do not push the envelope to see how far you can travel, because the DOT’s computer will catch you, and every ticket that is written means the CVSA will provide more funding for the location that wrote the ticket, so yes they want to give you a ticket! I would rather take the extra time for my 10 hour reset whether it is a split or a full 10, or my 34 hour reset and not be caught short and have an inspector put you OOS for 10 hours or god forbid 34 hours. Any time you move on PC you need to make sure that you have entered something into the movement, whether it be Safe Have, food, shopping, entertainment, etc. do not under any circumstances fail to put anything into PC so it just says Personal Conveyance, this truly angers Troopers and Inspectors.

Do you run specialized equipment or haul unusual freight? If so, it might be a good idea to proactively inform law enforcement about safety concerns. Roadside commercial vehicle enforcement officers (i.e., officers trained as per the Commercial Vehicle Safety Alliance (CVSA)) have to inspect all sorts of vehicles and cargoes during their shifts. Most vehicles are similar to other ones, but some are unique enough that the officers may not know how to safely do their jobs around them. Yes, officers get all sorts of regular training on doing inspections and how to keep themselves safe. However, their training doesn't cover everything, especially things that are new to the industry. If you operate equipment like alternative fuel vehicles (i.e., battery-electric, compressed/liquified gas, hydrogen, etc.), and specialized trailers/auxiliary equipment, or if you haul unusual and potentially dangerous loads, it's a good idea to train drivers to be able to communicate hazards to officers before an inspection begins. This can help them do their jobs safely and has the added benefit of building trust between the carrier and enforcement. In addition to training drivers on this topic, companies can also: - Provide printed infographics/information sheets on any unusual hazards with the vehicle, its equipment, and/or its cargo. - Install signs/decals in appropriate places using language/symbols that can be understood by people who are not familiar with the company's operations. - Proactively contact law enforcement agencies along the company's routes to give them this information ahead of time. This could include calling individual scales, emailing/calling enforcement agencies, and using any other communication channels available. Finally, this isn't just something that should be done for law enforcement. These exact measures can also be taken with first responders to help make them aware of unique hazards should they have to respond to an incident involving the vehicle. --- Not sure how to start with something like this? Yet another road tractor lift due to connected chassis twistlock(s), while, it must be assumed, the RTG is not fitted with any type of CATL system to cut the hoist to prevent this happening. [Maybe it's an empty box, so a weight-based detector system would not "see"it?]. At least the truck driver exited the cab prior to spreader landing (a safety protocol at the terminal?), but he appears to be insouciantly standing perilously close to the fall zone in the event of any spreader T/L failure(s). It seems to me that perhaps trucking companies don't understand the issues associated with their insurance. I would at time cite carriers for Part 387.9 if they didn't have the $1,000,000 of insurance as required or Part 387.15 if the carrier's MCS Form-90 didn't have the $1,000,000 listed. https://lnkd.in/ghgGTPKY It would annoy me that insurance carriers would only issue MCS Form 90s for $750K vs $1,000,000 because the carrier checked off on the box indicating they were a non-hazmat carrier, so the authority only/MCS Form 90 reflected what the carrier needed, not had. Before 2010 I called L & I and got instructions how carriers could change their "Required Insurance." Once the change was filed the insurance companies filed the BMC-91X to update the carrier's MC information and issued a MCS Form-90 to reflect the amount of insurance the carrier had. FYI! However... in my work For HazMat Government Contracted Motor Carriers, I ALWAYS run into someone "In the Office" that doesn't quite understand how Trucks operate. There ARE NO FEDERAL Motor Carrier Safety Regulations governing the use of "DEF"..... HOWEVER, there are State Laws governing Environmental Standards and if Enforced then YES, there is a Federal DOT Regulatory Site that may be used in assigning Civil Fines and Citations or Penalties. 49 CFR Part 392.2 is known in my former FMCSA Investigator Career as "Violations of State and Local Laws", and it's quite possible your company may recieve Violations of State and Local Laws that can or may be also reflected as a 392.2 Violation.
