Hello everyone we all do know kick backs in the mortgage world is not legal by no means. At least here is what I learned in LO Texas Law… What are the rules for kickbacks in RESPA? No person shall give and no person shall accept any fee, kickback or other thing of value pursuant to any agreement or understanding, oral or otherwise, that business incident to or part of a settlement service involving a federally related mortgage loan shall be referred to any person. This is straight from the law book. Several years ago there was a mortgage brokerage in Frisco that committed this act, 5 years after the fact, 52 people we’re indicted and 40 plus went to jail!! I suggest to work hard, do the right thing by all and build real relationships on ethics, honesty, and trust. Committing or suggesting an illegal act is already a breach of trust! Buyer's TOP 10 Essential Questions for Lenders! Freddie Mac and Fannie Mae have different views on how topics are tackled. A loan officer will select the program and Freddie/Fannie PATH that will get the Buyer to settlement, THEN the'll look at the best pricing. 1). Age of Docs: Docs are generally good for 120 days (Including Appraisals, income, assets, and credit reports). TITLE however is good for 90 days. 2. Appraisal Transfers: Generally not permitted on Conventional. FHA and VA loans require the appraisal to be assigned to the lender. 3. Living Trusts: The mortgage applicants must be the beneficiaries of the trusts. The Trust must be a Revocable Trust. We require complete copies of the trust. Depending on who the loan is locked with, additional requirements may apply. 4. Mortgage Lates: The mortgage applicants must be the beneficiaries of the trusts. The Trust must be a Revocable Trust. Lenders require complete copies of the trust. Depending on who the loan is locked with, additional requirements may apply. 5. Power of Attorney: Must be declared before the time of lock. For Freddie Mac, a documented hardship is necessary to approve a POA. Under Fannie, POA must be recorded prior to the recording of the DOT/Mortgage. It should only be used in rare cases, not for convenience, and the acting party cannot be an interested party in the transaction. VA loans using a POA require an Alive and Well statement to be completed by the title company. 6. Private Roads: a) Fannie: A Recorded Road Maintenance Agreement is required if the property is on a private road and not in a PUD or Condo. b) Freddie: The subject property must have appropriate ingress and egress. Streets must meet community standards. c) FHA, VA and USDA: If a private road maintenance agreement exists, then it must be provided for the loan file. If no private road maintenance agreement exists, and the appraiser and title company confirm this, lenders can proceed if there is a permanent recorded easement for the private road. The appraiser must also confirm the road is an all-weather surface. 7. Repair Escrows: Only allowed for specific weather-related items, subject to prior management approval. Borrowers cannot complete the work themselves. Jumbo loans do not allow repair escrows. 8. Sales Contract: Personal Property: Personal property should not be included in a real estate contract. Some lenders may accept an addendum indicating personal property's value as $0.00. 9. Separated Borrowers: Borrowers who have separated from their spouse, but have not signed any legal agreements yet, must still execute a notarized statement from each party that states that no legal document exists and that neither party are obligated to pay alimony or child support. 10. Timeline: Once a purchase contract is received, the timeline is set in motion and cannot be paused. Lenders will continue to push forward to meet their obligation, even if obstacles arise.

I had a gut-wrenching conversation yesterday at the Texas Mortgage Bankers Association Education Symposium annual event. I was talking to a mortgage lender (large company, operating in nearly every state) who went through the whole onboarding process to bring about fully digital closings with eNotes for their company. After getting all set up with their eVault, warehouse lenders, etc.....they operated for a while, only to pull the plug entirely. No more paperless closings. Going BACK to paper. Yikes. 😦 Why?? I'm sure my poker face was out the window. I was flabbergasted. "Didn't get used enough" is what I was told. I could go down a very long rabbit trail here....but the main point backs up what I've been posting about for months. It's simply a lack of awareness and education. LOs likely don't know it's available, so they aren't telling their realtor partners. Buyer's agents don't think they can influence the listing agent. Everyone assumes the listing agent will direct the title company. MOST assume that closing digitally is not a thing, so they don't ask. Most title companies don't have the ability to offer a digital closing. And around and around we go. I need a national stage to talk about this from!! Who's got one?? 🤣 #papersucks

Credit card point redemption strategy and marketing matter. Bilt Rewards is losing Wells Fargo $10M a month on point issuance, ask consumers use it to pay their rent, and then nothing else. As a result, Wells is unable to make money off of balances and other services. When you getting in store credit card, you'll notice that many non-repetitive purchases like furniture will be on a closed loop card, mainly because they know it's a financing tool. In the other situation, there is an open loop option, branded as Visa or MasterCard typically, which is trying to be promoted as a "top of wallet card", which encourages regular card spend, drastically changing the financial modeling for the issuer. In this situation, the card is being used as a one-time use style card, but was modeled off of a top of wallet go to market strategy. How you market your card is extremely important, and compliance teams should take note, that is not always about legal compliance. Trimont Set to Become the Largest Commercial Loan Servicer in the U.S. with Wells Fargo Acquisition In a landmark deal set to reshape the commercial mortgage landscape, Trimont is poised to become the largest commercial loan servicer in the United States. This comes after the company announced its acquisition of a significant portion of Wells Fargo's loan servicing business. Wells Fargo, which led the commercial mortgage servicing industry in 2023 with a staggering $669 billion in managed debt, is selling its nonagency, third-party commercial mortgage servicing unit to Trimont. This acquisition is a game-changer for Trimont, propelling its U.S. loan servicing portfolio to $640 billion and giving it a commanding 11% share of the market. Globally, Trimont's reach will expand to $715 billion in serviced loans across 72 countries. Expected to close in early 2025, the deal will see Trimont taking over the servicing of approximately $475 billion in loans. Additionally, 710 Wells Fargo employees will transition to Trimont, nearly doubling its debt servicing team to over 1,100, with the majority based in Charlotte, North Carolina. Before this acquisition, Trimont managed 2,696 loans and real estate-owned properties, positioning it as a powerhouse in the industry. Trimont CEO Bill Sexton commented on the acquisition, stating, "Trimont is very strong in the nonbank lending sector. The division we're acquiring out of Wells Fargo is very focused on the capital markets and securitization market. Putting these two businesses together now, we think, positions our business really well for what is coming in this stage of the cycle." Wells Fargo is refocusing its efforts on more profitable sectors like loan origination and securitization. The bank has seen a significant increase in its Commercial Mortgage-Backed Securities (CMBS) issuances this year, jumping to $15.2 billion from $2.2 billion in 2023. Despite scaling back its $475 billion servicing portfolio, Wells Fargo faces a 5% rise in nonperforming assets, particularly in the office property sector. As $2 trillion in debt is set to mature over the next three years, Trimont, owned by Värde Partners, is strategically positioned to take advantage of the growing demand for loan services, especially in the CMBS and Collateralized Loan Obligation (CLO) markets. On the other hand, Wells Fargo's decision to narrow its focus on core businesses marks a significant shift from its previously dominant role in real estate lending. Yesterday, the Federal Housing Administration and HUD Office of Housing (#FHA) announced plans to increase allowable leverage on FHA-insured #multifamily loans. As a rule of thumb for a 300-unit property in Texas, if these changes are adopted as proposed, they will: -         Increase Market-Rate new construction loans $1-2 million; and -         Increase Workforce Housing/PFC new construction loans $2-3 million. The proposed changes will also increase leverage for nearly all refinance transactions (including LIHTC properties). Even now, prior to these changes taking effect, FHA multifamily loans provide the highest leverage and lowest rate, non-recourse debt, available to multifamily owners and developers. #housing
