Can a single governor rewrite the law? 🤔 We don’t think so. That’s why we are calling on the California Supreme Court to review Ghost Golf, Inc. v. Newsom and restore clear standards for the California Constitution’s nondelegation doctrine—in support of Pacific Legal Foundation's challenge against Gov. Newsom's unlawful orders! 💪 https://lnkd.in/g3pBwCPB During the COVID-19 pandemic, Governor Newsom used the Emergency Services Act (ESA) to unilaterally impose shutdown orders and new laws. The lower court upheld this sweeping power, overlooking the need for specific legislative guidelines and safeguards. The ESA’s grant of authority to Newsom directly conflicts with the California Constitution, which forbids executive legislative power. Additionally, the ESA’s supposed safeguard—a concurrent resolution to end emergencies—fails to meet constitutional standards. The California Supreme Court must clarify how legislative power should be properly delegated to prevent future abuses. As NCLA’s Sheng Li puts it, “Two wrongs don’t make a right.” It’s time to correct the lower court’s flawed ruling and uphold our constitutional principles! ⚖️

Coba’s Capitol Comments by ACEC Oregon Lobbyist Marshall Coba,  Coba Company Government Relations   Governor Signs Duty to Defend Bill into Law   Good news! Yesterday, Governor Kotek signed SB 1575, the ACEC-sponsored "Duty to Defend" bill. Her signature was a great ending to a 4-year effort to bring fairness to construction contracts by removing onerous duty to defend clauses for public projects. It also signifies her support for the concept even as opponents maintained a significant post-session effort asking her to veto the bill.   The Governor wrote a signing letter outlining her thoughts on the bill. We remain confident that the concerns of state and local governments won’t be an issue as there have not been any issues in other states that have passed this legislation.    Read the Governor’s signing letter here: https://lnkd.in/gX7j5Utn   The route SB 1575 took to passage can be seen here: SB1575 2024 Regular Session - Oregon Legislative Information System (oregonlegislature.gov)   The bill will apply to construction agreements and contracts entered into or renewed on or after January 1, 2025. Since the bill has a ten-year sunset clause, we will need to remove the sunset clause prior to December 31, 2034 or the law reverts back to the law prior to passage. In this case, there was no law specifically regulating duty to defend clauses. We expect to remove the sunset clause once we have our expected track record of success well before the end of 2034.   Congratulations to all who will benefit from this effort on public construction projects after January 1, 2025. Thank you to all ACEC members and others who stepped up to testify, write letters of support, reach out to your legislators, or helped in many other ways. This was a fight and our opponents were from all levels of government from all areas of the state. We will offer all of these opponents an educational opportunity to ensure they comply as intended.

Having extensive experience in regulating and managing water appropriations has allowed me to explore the balance between tribal sovereign rights and State sovereignty. It's a nuanced process to align these interests, but I have come to deeply appreciate and respect the perspectives of our tribal communities. ALERT | California Governor Announces PAGA Reform Deal Reached, Removing Ballot Proposal | 07.20.2024   On June 18, 2024, Governor Newsom’s office announced that the pending ballot initiative to repeal PAGA (the Private Attorneys General Act) would be removed from the November ballot, due to a “negotiated deal,” reforming PAGA in a way that, “works for both business and workers,” and will “bring improvements to this system.” This package was, per Politico, negotiated over several weeks “behind the scenes.” This is similar to recent FAST Act reforms that were removed from the ballot, and also negotiated behind the scenes, and benefitting some parties more than others.
