A new set of criteria for qualifying for a public convenience and advantage waiver was proposed at today’s Cannabis Control Board meeting. The criteria include the following: 1. Distance from Other Retail Dispensaries: The proposed location must be at least: - 1,000 feet from any existing retail dispensary in jurisdictions with a 1,000-foot minimum distance requirement. - 2,000 feet from any existing retail dispensary in jurisdictions with a 2,000-foot minimum distance requirement. 2. Geographic, Structural, or Topographic Barriers: The existence of barriers (such as waterways, major roadways, highways, or significant travel distances) that separate the proposed location from existing dispensaries. 3. Travel Distance: The actual distance between the proposed location and existing dispensaries, as measured by pedestrian or vehicle routes. 4. Unique Factors of the Proposed Location: Factors that may justify the location, such as: - High consumer demand for additional retail dispensaries or microbusinesses. - The presence of illicit or former illicit cannabis dispensaries near both the proposed and existing locations. - Other relevant factors that may support the need for greater access to adult-use cannabis in the area. 5. Notification to Local Authorities: The licensee must send a notification to the local municipality or community board, informing them of their intention to request a waiver from the Board for not meeting the 1,000-foot or 2,000-foot minimum distance requirement. The municipality or community board will have 45 days to respond before the Board considers the application. Mr. Kagia mentioned that the Board would consider more than this information alone when deciding to grant a waiver and that it would be up to their discretion. Chairman Wright raised concerns about the 45-day period, and the Board voted to approve the criteria with an amendment for licensees who have already received municipal support.

Deeper examination and application of retail cannabis sales data in New Mexico. #themoreyouknow #newmexicocannabis #cannabisdata Take Las Cruces --> 68 storefronts that reported REC sales last month. 📍 Only 18 of these 68 storefronts have reported two consecutive months of REC sales gains. 📍 The top 10 storefronts in Las Cruces recorded 53.4% of total REC sales last month in New Mexico's 5th largest retail market (factoring TOTAL sales). That leaves just 46.6% of REC sales to be split among the remaining 58 retail storefronts. 📍 LC features a median REC sales figure of just $15,980. 📍 40 storefronts in LC reported REC Sales in AUG '24 of < $25,000. The ability to sort and filter timely and relevant retail sales data in hyper-saturated markets like LC is priceless!

Building a true brand-driven MSO   Most cannabis executives and sector analysts concur: Winning MSOs will be brand-driven. Great, but what does that mean in practice and how do you get there?   A strong brand is more than a logo or THC level. It is a promise of value reliably delivered to consumers – and, if done right, a provider of strong margins and sustainable advantage for producers.   I've worked with some of the biggest consumer & B2B brands in the world (e.g., P&G, Merck, AmEx) plus many ambitious Canadian and US weed brands.   Here's what I learned in cannabis. It doesn’t matter how many CPG people you hire, the amount of executive ‘happy talk’ or how much money you throw around.   Great brands will emerge from the creation of a brand development engine that forms the core of how a firm competes. This engine is built on a foundation of strategic clarity, an unwavering focus on channel & consumer needs and the assembling of enabling capabilities such as market research & analytics, innovation, and product line management.   One MSO that is dialed into this advanced thinking is Ayr Wellness.   Ayr’s go-to-market strategy is based on the notion of a ‘flywheel’. This is an understanding that the company is simultaneously seeking to be a retailer of choice and a house of sought-after CPG-like brands. Their operational ‘secret sauce’ includes quickly capturing and leveraging market & consumer learnings, ensuring quality throughout the supply chain and designing the ideal consumer brand portfolio and experience.   This approach seems obvious, but it is not. Many MSOs plan/execute their retail and brand strategies in silos, thereby increasing complexity, hindering learning and challenging cost minimization efforts.   For Ayr’s differing brand and retail strategies to work, they need to support one another and leverage available synergies. For example, Ayr’s CPG brands need strong equity and a unique identity, and not be seen as ‘me too’ house brands. Ayr has rationalized its brand portfolio from 12 single-form factor brands to 2 core brands that cross form factors to ensure that each provides a differentiated value proposition and carries a strong physical and digital presence. When done successfully, brands can become a driver for retail, much like carrying Coca Cola is de rigueur for any grocery chain.   On the other side of the flywheel, Ayr’s strong retail platform gives them the ability to launch/build brand equity through readily available shelf space, a supportive retail service team and direct access to market data. This could be the sign we have been waiting for to file intent-to-use trademark applications for cannabis. This indication from the DEA would allow for a bona fide intent to file an intent-to-use application for cannabis goods and services, as the current rejections based on the CSA should not apply after the rescheduling.
