In the first quarter of 2024, with federal cannabis-reform efforts not yielding any practical changes, Curaleaf made a strategic decision to enter the hemp market. This is a trend we are starting to see. Cannabis can only be sold in the state it was produced and only allowed to be sold through dispensaries (in a hand full of states such as #california it could be sold through a delivery service). Intoxicating products that derived from hemp, are legal to ship across state lines, are available via e-commerce and mainstream retail channels. As well the producers of the products do not need to comply with burdensome licensing requirement and predatory taxation. A lot of politicians say that they support small businesses, but for small cannabis businesses to be able to properly compete, they need to have access to the same distribution channels as #hemp. F the Treaties: Rescheduling and Marijuana-Particular Controls https://lnkd.in/gwnhJv2Z <a href=""> - Marijuana-specific controls in schedule III? The drug Enforcement Administration (DEA) revealed its Discover of Proposed Rulemaking (“NOPR”) final week to a lot fanfare. The NOPR would reschedule marijuana, “marijuana extract” and “naturally derived delta-9 tetrahydrocannabinols” from schedule I to schedule III of the Managed Substances Act (CSA). However that’s not all. In my very fast evaluation after the rule dropped, I flagged DEA’s assertion that it might develop “marijuana-specific controls” together with rescheduling. I’m shocked this DEA assertion hasn’t spurred a lot dialogue, regardless of its Easter egg placement at NOPR web page 86. “Marijuana-specific management” guidelines might turn into a reasonably large deal. 🚀 Highlights from the August 6, 2024, NYS Cannabis Control Board Meeting Here are the top takeaways from the latest meeting of the NYS Cannabis Control Board: 1. Retail Applicants Approved: -86 New Adult-Use Licenses: Including 22 retail dispensaries, 16 microbusinesses, 19 cultivators, 11 distributors, and 18 processors. -See the attached chart to review progress in the November Queue. 2. Changes to Allowances for Public Convenience: -The Board proposed new regulations for waiving the distance requirements between dispensaries in the name of public convenience. -The following will be considered: 1. The number, classes, and character of other licenses in proximity 2. If all necessary licenses and permits have been obtained  3. Whether there is a demonstrated need for such a license 4. The effect on pedestrian or vehicular traffic and parking 5. Noise levels 6. A history of cannabis violations and reported criminal activity  7. Any other factors specified by law or regulation 3. Clarification on Deficiency Responses: -It was mentioned that deficiencies must be responded to within 30 days, when previously it was emphasized that they needed to be resolved in that time. This distinction gives applicants more peace of mind when dealing with difficulties related to OCM technology. 4. Agenda Adjustments: -Aligned with decisions made in their previous meeting, the Board removed denials from the agenda at the last minute, focusing instead on moving forward with the application process and support for successful candidates. Licensing Update: -The state now boasts 156 licensed dispensaries with June retail sales reaching $71 million. Total sales since the program's launch are approaching half a billion dollars. -Nearly all conditional cultivators and processors have applied for full licenses, and the majority have been approved, with the expectation of closing out these applications in the next 2 meetings to focus on December supply side licenses. It was great to join Yahoo Finance’s today to discuss the impact that rescheduling will have on the cannabis industry and #Curaleaf. The DEA has moved to reschedule cannabis from Schedule I to Schedule III. This is a crucial step in undoing the harms caused by the failed and discriminatory War on Drugs, reducing the stigma of the plant and in recognizing cannabis as the legitimate business and medical alternative that we all know it is.  This decision will positively impact the entire landscape of the cannabis industry. For Curaleaf, it will lead to relief from the burdensome 280e tax provision, and for our patients and customers, greater access and acceptance to the products of their choice.  There is still a significant process ahead, including a 60-day public comment period that will likely begin in May, followed by a review by a Justice department administrative law judge and the White House Office of Management and Budget. Once complete, the DEA will present all comments to the administrative judge and, not including potential lawsuits by dissenting organizations, the new schedule 3 designation could come into effect as early as October-November of this year, or sometime in the first half of 2025. And with acres down 95% since 2019 and most using foreign CBD, how is it that U.S. farmers benefit? While “hemp” delta-x vape pens sold in gas stations might just be the thing that gets marijuana legal, it is creating an existential crisis for the real hemp (grain/fiber) side. Not even in our darkest, most prohibitionistic paraquat years like the Reagan ‘80s did people want isomerized (synthesized) THC. We knew it could be done, but why? Weed is grown in almost every county in the nation, just find a better plug. It's as much hemp as a synthetic digoxin pill is a foxglove plant, but "it is difficult to get a man to understand something when his salary depends upon his not understanding it." The cannabis companies that ‘WIN’ in 2025 and beyond will have these five things in common: 1) They understand the scale that they are trying to achieve and their entire operation is appropriately focused based on that scale. -Local companies need to market and connect locally (in an extremely authentic way) while focusing on profitable, sustainable revenue streams that are mostly consumer driven. -Statewide companies need to do the hard math and modeling to understand what realistic growth means for them. Set specific growth targets based on achieveable modeling. Too many statewide brands operate, market and spend like a national brand, and it will cost them in the end. -National brands must focus on lean profitability and maintain a highly targeted approach to their spending, despite a world that may seem like it has limitless customers. 2) They don’t try to do it all. Developing mastery and economies of scale in specific sectors, while building strong partnerships in the rest of the market, is the model for success in the years to come. The great companies from 2025-Federal Legalization will seek out expansion via truly strategic partnerships (and careful aquisitions) while the mediocre companies attempt to do it all themselves. The largest, best capitalized MSOs will be buying up statewide and regional businesse with lean, focused, positive-cashflow operations, which solve specific problems in their infrastructure. 3) They are building a business that is designed for the New World of Cannabis, and the Era of Commercialization. -We aren’t trappers anymore. -Hitting licks can only take you so far. -Weed is a CPG product. -THCA is sold openly online and in gas stations. -D9 Bevs and Gummies are sold in some of the deepest red states. -Weed by mail is probably here to stay. -Mushrooms are legal in various cities and states. -Consumer trust in a brand is the most valuable asset in the industry. No matter their scale, the companies that win in the next five years will integrate themselves into the new ways consumers interact with and purchase cannabis…. (Online, DTC, Low-Dose, Mixed Nootropic, Bev, Smoke Shop/Gas Station, Mass Market, Seshes, N.A. bars/lounges, add-on dispensary licenses) 4) They build continuous feedback loops with their customers. The great brands and companies that succeed into the 2030’s will have a deep, data-based understanding of their consumers at all levels. Brands must understand the buying criteria of the stores that carry them as well as the buying criteria of the consumers that drive sell-through. The very best will encourage a rewarding consumer engagement loop that directly influences operational decision making. 5) They just don’t quit. (In fact, they continue to innovate, pivot, and understand that at the end of the day, their business is change). A lot of cannabis operators will quit in the next five years. In all business, but especially in cannabis, sometimes it’s just about being there tomorrow.

Only 27% of cannabis businesses are profitable, down from 42% in 2022. When it comes to minority owned businesses only 17.5% are profitable. According to The US Chamber of commerce, 65.3% of all small businesses in the U.S. are profitable. There is no easy fix, but starting at the local level is really important and a lot of times overlooked. Very restrictive zoning, creates an artificial shortage of available real estate. Real estate is usually the biggest cost and because of limited supply landlord charge outrageous rent. A lot of local governments charge predatory permitting fees and have very lengthy process to get permitted. We are less then three months away from the presidential election. Conventional wisdom may label the #cannabisbeverage sector as a passing fad due to its small market share. However, entrepreneurial insight suggests that #Cannabis #beverages will emerge as a dominant sector among cannabis products in the near future. The true perspective lies not in pessimism or optimism but in a deeper understanding of evolving markets and the factual data that is becoming apparent. The fact of the matter is that recreational dispensaries and the distribution model within these recreational cannabis states are not set up for the proper delivery and handling of cannabis beverages. With the segue of the hemp market allowing cannabis beverages to sit alongside alcohol, the acceptance/embracement of the players in that industry, and the availability for cannabis beverage brands to position themselves on a national level and create this footprint ahead of federal legalization, is monumental. Cannabis is and has always been a commodity; just like sugar and flavoring that go into these drinks. It has been almost 11 years since #colorado started adult use sales. Now the vest majority of americans live in a state where cannabis is legal for medical or adult-use. We are starting to get reliable data. Data about consumer behavior is really important. New Frontier Data conducting a survey on the difference between people that use cannabis medically versus recreationally. They found that medical patients are typically are the most loyal customers and spend far more than adult use consumers. Adult use consumers are the most likely to obtain their cannabis for free and the most likely to spend under $50 when they do buy cannabis. Medical patients are the most likely to spend $400+ when they purchase cannabis. This reflects the need of medical patients to have consistent access to the same products.
