CALL TO ACTION: REFORM DC EVICTION LAWS TELL THE COUNCIL TO SUPPORT The "Emergency Rental Assistance Reform Emergency Amendment Act of 2024 WHAT DOES THIS BILL DO? On Tuesday, October 1, 2024, the DC Council will vote on "The Emergency Rental Assistance Reform Emergency Amendment Act of 2024." Sponsored by Chairman Mendelson, the bill requires nine votes to pass and introduces key changes to ERAP. 1. Ends Automatic Stay of Eviction Cases Currently, Landlord & Tenant Court judges must pause eviction cases if a tenant applies for ERAP. This amendment allows the court to offer a one-time conditional stay only if: a) Proof is provided that ERAP will fully cover the rent owed, or b) The tenant has entered a repayment plan with their housing provider. 2. Ends Self-Certification Today, tenants can self-certify eligibility for ERAP without any documentation. This amendment will require tenants to provide evidence of an unforeseen emergency, such as job loss or medical issues, that impacts their ability to pay rent. WHY IS THIS BILL NEEDED? The Rental Housing Industry is in Crisis Housing providers in DC—both market-rate and affordable—are still reeling from the COVID-19 pandemic. Many are facing record rent delinquencies, a broken eviction process, and soaring costs. During the pandemic, the DC Council enacted laws that severely delayed the eviction process. These laws tripled the time required to evict non-paying tenants, causing lawyers to stop taking eviction cases altogether. Some tenants have gone years without paying rent. In many cases, bad actors engage in illegal activities, terrorizing neighbors and owners, while landlords wait months for eviction proceedings to go through. DC housing providers have collectively lost hundreds of millions in unpaid rent, and small landlords are facing foreclosure and financial ruin. Some are seeing their life savings and retirement plans wiped out. Even large nonprofit providers like Neighborhood Development Corporation have announced they are going out of business. A recent study found that 80% of affordable housing providers with District-backed loans are on the verge of foreclosure. The crisis is so dire that Mayor Bowser has diverted $80 million from the Housing Production Trust Fund—funds meant for new construction—to help these struggling providers. THIS IS JUST THE FIRST STEP This bill is a small but necessary first step toward meaningful reform of DC's eviction and landlord-tenant laws. The affordable housing sector in DC is in freefall, with major investors and lenders pulling out of the city. The Council must thoroughly reassess the anti-landlord measures passed during the pandemic and stop experimenting with laws that don’t work. Neighboring states like Maryland and Virginia aren’t experiencing these same issues, and DC’s laws must evolve to address this imbalance.
