Why is my process server requesting a motion and order to appoint a process server? To effectuate proper service of process in Florida we must follow the civil rules and statutes to avoid a motion to quash or jeopardize your case. To serve a summons we must ensure the person effectuating service must either be appointed and regulated by a sheriff (FS 48.021) or a chief judge of a circuit court (FS 48.27) all other counties that do not have a licensing program by the sheriff or chief judge must then be appointed by a motion and order from the courts that the case was filed. We cannot serve a summons in the 13 counties listed below without a signed motion and order appointing a person to be the process server for that specific case.    Alachua Gilchrist Washington  Baker Holmes  Bradford Levy  Calhoun Putnam  Clay Union  Flagler Volusia      Florida Statute  48.021 Process; by whom served.—(1) All process shall be served by the sheriff of the county where the person to be served is found, except non-enforceable civil process, criminal witness subpoenas, and criminal summonses may be served by a special process server appointed by the sheriff as provided in this section or by a certified process server as provided in s. 48.27. Civil witness subpoenas shall be served by any person authorized by the rules of civil procedure.    Florida Civil Rules of Procedure   Rule 1.070 (b) Service; By Whom Made. Service of process may be made by an officer authorized by law to serve process, but the court may appoint any competent person not interested in the action to serve the process. When so appointed, the person serving process must make proof of service by affidavit promptly and in any event within the time during which the person served must respond to the process. Failure to make proof of service will not affect the validity of the service.
