Will the Ninth Circuit take this case on appeal? In my opinion, there is no nexus for making property owners bear the burden of supplying #affordablehousing in our communities. All members of society should bear the burden or put pressure on our elected officials to make policy changes that increase #housing supply and lower the cost to build new homes. “Despite its name, Seattle’s Mandatory Housing Affordability law does the opposite of what it intended — it makes it unaffordable for people like Anita to build housing on their own property,” Institute for Justice attorney Suranjan Sen said in a news release. The role of the Takings Clause is to ensure that particular individuals are not forced to “alone . . . bear public burdens which, in all fairness and justice, should be borne by the public as a whole.” In considering a challenge to a governmental action or regulation relating to private property, the Court must first evaluate whether a taking has occurred. https://lnkd.in/g28ap93N

Are you a landlord in California? If so, then read on. The Commercial Tenant Protection Act (SB 1103) will go into effect on January 1, 2025. The first-in-the-country commercial protections for small commercial tenants was signed into law by Governor Newsom on September 30. The legislation was hailed as a victory by some small business groups, who feel it creates a more balanced and fair commercial leasing environment for small businesses. 📢 Important Update: Gov. Newsom Signs PAGA Reform Legislation 📢 We are thrilled to share a significant development for California businesses and workers! On July 1, 2024, Governor Gavin Newsom signed crucial reforms to the Private Attorneys General Act (PAGA) into law. These reforms are designed to strengthen worker protections, encourage employer compliance, and streamline litigation processes. Key Highlights: Reform Penalty Structure: Penalties on employers are capped for those who take reasonable steps to comply with the Labor Code before receiving a PAGA notice and for those who act promptly to rectify issues after receiving a notice. Higher penalties are imposed on employers who violate labor laws maliciously or fraudulently. Streamlining Litigation: The reforms expand the sections of the Labor Code that can be cured to reduce unnecessary litigation and allow employees to receive remedies more quickly. Small employers benefit from a more robust right to cure process through the Labor and Workforce Development Agency (LWDA). Injunctive Relief and Standing: Courts are empowered to provide injunctive relief to compel businesses to implement necessary changes and require employees to personally experience the violations they claim. Strengthening Enforcement: The Department of Industrial Relations (DIR) will expedite hiring to ensure effective enforcement of labor claims. Last week, Governor Newsom signed AB 2288 and SB 92, amending California’s Private Attorneys General Act (PAGA). These changes, effective for PAGA notices sent on or after June 19, 2024, aim to provide relief to employers by introducing stricter standing requirements for plaintiffs, expanded cure opportunities, and reduced penalties for compliant employers. Key updates include limiting plaintiffs to pursue penalties only for violations they personally experienced, broader options for employers to cure past violations, and increased chances for early settlement.
