𝗜𝘁 𝘀𝗲𝗲𝗺𝘀 𝗹𝗶𝗸𝗲 𝗮 𝘀𝗰𝗲𝗻𝗲 𝗳𝗿𝗼𝗺 𝗮 𝗱𝘆𝘀𝘁𝗼𝗽𝗶𝗰 𝗻𝗼𝘃𝗲𝗹: a stranger breaks into your house and takes up residence there. You call the police, and, rather than removing the intruder, they tell you that you are the one who is not allowed inside. Unfortunately, in certain parts of the United States, this scenario is real and legal due to a once obscure legal protection called squatters' rights. With stories of landlords losing their properties to squatters in places like New York and California circulating on social media, increasingly, landlords I know have been asking, 𝗖𝗮𝗻 𝘁𝗵𝗶𝘀 𝗵𝗮𝗽𝗽𝗲𝗻 𝘁𝗼 𝗺𝗲 𝗶𝗻 𝗢𝗵𝗶𝗼? My answer, although I must clarify that I'm speaking as an insurance agency owner, not as an attorney, is, no. 𝗪𝗵𝘆 𝗱𝗼 𝗜 𝘀𝗮𝘆 𝘁𝗵𝗶𝘀? I don't mean to suggest that landlords in Ohio should be lax in taking care of their properties or securing them from unauthorized entry. I mean simply that squatters' rights in Ohio, though real, are nowhere near as slanted in favor of the squatter as they are in states like New York. In Ohio, for example, a squatter has to occupy a home for 21 years without interruption before they can file a claim to become the legal owner of the property. In New York state, however, a squatter can file for legal ownership after only 10 years. But this difference, though substantial, is not the most important one. 𝗧𝗵𝗲 𝗸𝗲𝘆 𝘁𝗼 𝘂𝗻𝗱𝗲𝗿𝘀𝘁𝗮𝗻𝗱𝗶𝗻𝗴 𝘄𝗵𝘆 𝗹𝗮𝗻𝗱𝗹𝗼𝗿𝗱𝘀 𝗶𝗻 𝗢𝗵𝗶𝗼 𝗵𝗮𝘃𝗲 𝘀𝗼 𝗺𝘂𝗰𝗵 𝗹𝗲𝘀𝘀 𝘁𝗼 𝘄𝗼𝗿𝗿𝘆 𝗮𝗯𝗼𝘂𝘁 𝗹𝗶𝗲𝘀 𝗶𝗻 𝗲𝗮𝗰𝗵 𝘀𝘁𝗮𝘁𝗲'𝘀 𝗱𝗶𝘀𝘁𝗶𝗻𝗰𝘁 𝗰𝗼𝗻𝗰𝗲𝗽𝘁𝗶𝗼𝗻 𝗼𝗳 𝘁𝗲𝗻𝗮𝗻𝘁𝘀' 𝗿𝗶𝗴𝗵𝘁𝘀. Squatters, though legally distinct from tenants, are typically subject to the same eviction laws. In Ohio, the eviction process is relatively short—between 3 and 30 days, depending on circumstances. In New York, however, the eviction process takes an average of two years. Squatters in New York state have the upper hand not so much because of the rights New York gives squatters but because of the rights they give tenants. There just isn't the same incentive to squat in Ohio as there is in New York. This is not to say that a hostile takeover by a squatter would be impossible in Ohio.
