To Qualcomm General Counsel Ann Cathcart Chaplin, the relationship between inside and outside counsel “really matters.” Here’s her advice to outside counsel on fostering trust and long-term relationships, from someone who’s been on both sides: - Give your client time to provide feedback. They are just as busy as you! - Tell your clients what you need. No matter how much your client tries, there will always be company information they haven’t fully conveyed. - Use the lines, “Are there things you want me to know in advance?” “What’s the most efficient way for me to get the information I need?” - Seek to understand your clients’ broader business in addition to the case. Sometimes winning the case isn’t the most important thing to their ecosystem. - Understand that as much as you care, in-house lawyers will inevitably feel more responsible for a case than you. Advance preparation and communication will help with handing over control. - Ask for feedback. Finishing a project is a great excuse to ask how you can be more helpful or what you can do differently. I know this will be controversial, and maybe I'm the wrong person to ask because I don't even play fantasy football, but I have felt for a long time that legal sports gambling was a terrible idea, and it appears that my gut feeling is supported by some empirical evidence. An excerpt: //... Because different states legalized sports gambling at different times, social scientists can compare different measures of well-being in states that did legalize with those that did not, before and after legalization. Alarming patterns have started to emerge. Two recent working papers look at the economic impacts of legalization. One, by Northwestern University’s Scott Baker and colleagues, finds that legal sports gambling depletes households’ savings. Specifically, for every $1 spent on betting, households put $2 less into investment accounts. States see big increases in the risk of overdrafting a bank account or maxing out a credit card. These effects are strongest among already precarious households. A second paper, from the economists Brett Hollenbeck of UCLA and Poet Larsen and Davide Proserpio of the University of Southern California, tells a similar story. Looking specifically at online sports gambling, they find that legalization increases the risk that a household goes bankrupt by 25 to 30 percent, and increases debt delinquency. These problems seem to concentrate among young men living in low-income counties—further evidence that those most hurt by sports gambling are the least well-off. A third recent paper, from the University of Oregon economists Kyutaro Matsuzawa and Emily Arnesen, shows another, perhaps more surprising—and certainly more harrowing—harm of gambling legalization: domestic violence. Earlier research found that an NFL home team’s upset loss causes a 10 percent increase in reported incidents of men being violent toward their partner. Matsuzawa and Arnesen extend this, finding that in states where sports betting is legal, the effect is even bigger. They estimate that legal sports betting leads to a roughly 9 percent increase in intimate-partner violence....//

Did you know that in September 2022, Gov. Gavin Newsom signed AB-156 into law, allowing court reporters who use their voices and stenomasks in lieu of hands and steno machines to capture the legal record in California? Like their steno machine colleagues, they must first pass the rigorous Certified Shorthand Reporter (CSR) three-part exam required by the Court Reporters Board (CRB) to work in California — and they are passing at an average rate of 70%. Get ready to see these new Guardians of the Record holding a mask in front of their mouths, because since January 2023, voice writers have been hired in courts throughout California and for depositions! You may wonder how using a mask can possibly work. Have you ever used a dictation machine? Voice writing is similar to that, with some important differences. While using a dictation machine, you get to take breaks as often as you want as you dictate, alone in your office, and someone else later types your words into a document, and punctuates and formats it. ✅ Voice writers capture the legal record at LIVE legal proceedings (court or deposition) by repeating verbatim what they hear into a mask as multiple participants speak at 200+ words per minute on the record. ✅ Voice writers take breaks when judges or lawyers take breaks, and their voices are captured by Dragon and their Computer Aided Transcription system (CAT), which creates their transcripts, and they later edit and finalize them. ✅ Besides repeating verbatim what they hear into a specialized, sophisticated mask, these highly trained legal professionals are identifying speakers accurately and punctuating and formatting their transcripts on the fly—while remembering to breathe so they don't pass out. ✅ Just like their steno machine writing colleagues, voice writers' fundamental duty is to protect the record, including interrupting briefly whenever the accuracy of the record is in jeopardy — as required by the CRB. 1️⃣ There are more similarities than differences between these two methods of capturing the legal record. Yesterday a General Order was released by Samantha P. Jessner, Presiding Judge of the Los Angeles County Superior Court. This order addresses the severe court reporter shortage in Los Angeles County by allowing Family Law Courts to record proceedings. Since 2018, court reporters have declined. As a result, hundreds of thousands of cases have not had a verbatim record of their court proceedings in just the last year and a half. This limits a person's ability to appeal a decision and risks their constitutional rights. The General Order is positive for many reasons: 1. It is not mandatory. Judicial officers can decide to record proceedings if it will be beneficial. 2. Recording equipment already exists in the courtrooms. 3. There is no intention of laying off current court reporters. In fact, a robust attempt will continue to be made to attract new court reporters. Court reporters will be preferred and used when available. 4. This will increase the level of access to justice individuals have. Currently, some people are paying out of pocket for private court reporters if their trial won't have one. 5. Electronic recordings will ensure fairness. This change will no doubt benefit individuals who have a case in the Family Law Division of the Los Angeles County Superior Court. #familylaw #losangelescountysuperiorcourt #courtreporters #familylawdivision

In the 2023 Year-End Report on the Federal Judiciary, Chief Justice John Roberts noted, “Rule 1 of the Federal Rules of Civil Procedure directs the parties and the courts to seek the 'just, speedy, and inexpensive' resolution of cases.” The ongoing statutory constraints in California—driven by opposition from stenographers, which has effectively halted Senate Bill 662—are limiting the use of digital recording technology that directly fills a resource gap and facilitates the more efficient resolution of cases. This setback significantly, and adversely, impacts the backlog of cases state-wide, exacerbating delays and imposing ongoing financial burdens on those seeking access to records of proceedings. On Thursday the 9th Circuit held hearings in NetChoice v. Bonta concerning the California Appropriate Age Design Code (CAADC). The judges focused on provisions related to harmful content, and how they implicate the First Amendment. I was quoted in this Bloomberg article saying: “For me, what matters is, how will they frame it?” Gaia Bernstein, professor of Law at Seton Hall School of Law, said in a news conference after the argument. “Because if they’ll frame their whole decision on tying it to harmful content, it’s not as bad for efforts to protect kids online from other things. On the other hand, if they do not really explain what they’re doing, then it could be viewed as a precedent that basically struck down efforts to regulate design.” Why am I concerned? - The CAADC contains many provisions to protect kids online, including provisions to protect kids against tech addiction. - If the Court invalidates all or part of the CAADC on First Amendment grounds it is important for the future of protecting kids online that it does so narrowly, expressly focusing on the harmful content provisions.

On June 7, 2024, the Nevada Supreme Court adopted changes to the Nevada Rules of Appellate Procedure (NRAP) that govern appeals before the Nevada Supreme Court and the Nevada Court of Appeals. NRAP 1(a). The changes become effective prospectively on Aug. 15, 2024, to all pending cases and cases initiated after that date. In appeals before these courts, appellate attorneys should consider carefully reviewing these requirements. Likewise, trial attorneys should familiarize themselves with these rules, too, because the amended rules and unpreserved issues at the trial court level can make or break an appeal. For this reason, it is important to understand appellate practice and focus on these issues throughout the case. In major cases, attorneys should consider having an appellate lawyer on the trial team to help ensure preservation of issues. Read more in the #GTAlert authored by Elliot Anderson:

The NInth Circuit just issued the Netchoice v. Bonta opinion today. This was an appeal from the district court, which held that the the California Age Appropriate Design Code (CAADC) violates the First Amendment. The decision is in some ways concerning because it delays kids safety online in the name of corporations right to freedom of speech. There is much to say. I will focus on what today's decision means for future legislation to combat tech addiction. the CAADC has two restrictions on addictive technologies. First, the good news. The CAADC contains a prohibition on dark patterns that can cause children to act in a way that could harm their health or well-being. The court stated that addictive designs could be viewed as dark patterns, and a dark pattern may not even be speech implicated under the First Amendment. It remanded this to the district court. The second restriction on addictive technologies was part of the Data Protection Impact Assessment (DPIA). It basically required tech companies to assess if a design extends a child's time online and mitigate it if needed. The court enjoined the entire DPIA without paying any attention to how this restriction is different. You can read more here.
