Paramount Bidder Steven Paul found Liable for Willful Copyright Infringement.
Following a six-day jury trial, a federal jury found Steven Paul and two of his companies, SP Releasing, LLC and Echo Bridge Acquisition Corp., liable for willful copyright infringement and circumvention of copyright protection systems in Harvest Aid LLC v. Steven Paul, et al., Case No. 2:21-cv-4154-SSS-KS. The verdict, which came down on the afternoon of June 27, 2024, awarded Harvest Aid $152,500, the maximum statutory damages allowable for the claims at issue.
The case concerned allegations that the Defendants, who were authorized to distribute DVDs of Harvest Aid’s faith-based film I Believe to Walmart, also manufactured and distributed counterfeit copies of that film. Harvest Aid learned of the counterfeiting from a closeout reseller who obtained 10 pallets of overstock DVDs, including thousands of copies of I Believe, from Echo Bridge when it was closing its WI distribution facility. After Harvest Aid advised the reseller that Echo Bridge had no right to sell the DVDs to anyone other than Walmart, the reseller returned the I Believe DVDs to Harvest Aid, who realized they were counterfeit. Prior to the closure of its WI facility, Echo Bridge told Harvest Aid that it had over 7,000 I Believe DVDs in inventory which it would return to Harvest Aid, but never did. The Defendants failed to explain what happened to those DVDs if they were not the counterfeit ones sold and shipped to the closeout reseller, or why the DVDs were never returned to Harvest Aid if they were authentic copies.
Mr. Paul is currently leading an investor group in its efforts to acquire Paramount Studios. He has reportedly been in negotiations with Shari Redstone in a bid for her holding company National Amusements. Bloomberg previously reported that Paul’s investor group made an offer that was more than the $2.25 billion offered by Skydance, but less than $3 billion.
