Kicking off our retreat in San Francisco with the State Bar of #Texas #Computer and #Technology law section where we will be exploring the new regulatory developments in #AI, #cyber, #privacy with #California’s Attorney General. Computer & Technology Section - State Bar of Texas

In its efforts to protect consumers, the #Texas Attorney General’s recent settlement sets groundbreaking precedence that requires #GenAI companies to comply with the #DTPA or face penalties. To demonstrate compliance, #AI companies must take additional steps to ensure the transparency and accuracy of outputs generated by the AI’s algorithms, such as the use of: 1) third party code audits to validate the accuracy of the AI; 2) clear and conspicuous disclaimers about the limitations and risks of using the AI; and 3) usage restrictions in its marketing materials and related license terms. Got questions? Let's talk! https://lnkd.in/grbGsa4c

Similar to its scrutiny of using #darkpatterns to influence consumer behavior, the #FTC is now investigating the anticompetitive usage of #AI that can potentially lead to price-fixing practices that manipulate #international markets. Before deploying AI in your operations, start by testing the AI solution in a limited market segment to avoid the concentration of market power. The AI license terms can also be the first contractual defense to minimize any collusion with third parties for the determination of prices. Finally, First Amendment protections to the AI #sourcecode should be analyzed to prevent any overreach of government regulations. https://lnkd.in/gRWa4gWG

The sharing of #USPS customer data with #bigtech #socialmedia platforms presents substantial privacy implications and liability concerns. By combining USPS #data with extensive digital profiles, there is a heightened risk of intrusive tracking and profiling, leading to potential privacy infringements. Customers might not be fully aware of or consent to the extent of data sharing, raising ethical and #legal issues. Furthermore, any data breaches or misuse could result in significant legal liability for the USPS, including penalties and loss of public trust. Ensuring rigorous data protection, transparency, and clear consent mechanisms is essential to address these challenges.
The U.S. Postal Service was sharing the postal addresses of its online customers with advertising and tech giants Meta, LinkedIn, and Snap, TechCrunch has found. On Wednesday, the USPS said it addressed the issue and stopped the practice, claiming that it was “unaware” of it. TechCrunch found USPS was sharing customers’ information by way of hidden data-collecting code (also known as tracking pixels) used across its website.
