The DC Circuit last month discarded ~50 years of precedent when it found that the Council on Environmental Quality (CEQ) never had statutory authority to implement National Environmental Policy Act (NEPA) rules (in Marin Audubon Society, et al. v. Federal Aviation Administration (FAA), et al.). The ruling has profound implications for energy project permitting in the US and also creates a new opportunity for Rio Grande LNG to regain its invalidated construction permit.
