The transition between presidential administrations is typically accompanied by a change in federal enforcement priorities, and the world of higher education is no exception. President-elect Trump has already promised to implement significant changes to the sector, such as proposing to eliminate the Department of Education. Other areas will likely see major changes as well, including antitrust litigation, foreign relations, the implementation and revision of education regulations, and increased congressional scrutiny. Attorneys Alex Wolf, Patrick Linehan, John D. Geilman, and Evelyn H. discuss how changes to these areas could impact colleges and universities in our recent client alert, “Higher Education Enforcement Under Trump 2.0: What to Expect?”: https://lnkd.in/eUKnNAh6

On December 10, the EU regulation on horizontal cybersecurity requirements for products with digital elements (Cyber Resilience Act) entered into force. The Cyber Resilience Act introduces harmonized rules for placing connected hardware and software products on the market, mandatory cybersecurity requirements, and corresponding obligations for actors across the value chain. It will impact companies that design, develop, produce, and make such products available on the EU market. For more information, read our recent blog post, “The EU Cyber Resilience Act Has Entered into Force: 10 Things You Need to Know About It,” authored by partner Anne-Gabrielle HAIE and associate Maria Avramidou: https://lnkd.in/eRpM-u3m

On December 4, the Federal Trade Commission (FTC) filed a formal complaint against Guardian Service Industries, Inc. over “no-hire” agreements, also known as “no-poach” agreements, which prevent building owners and other service contractors from hiring its employees. This is the first instance of such agreements being challenged in vertical contracts but may foreshadow a weakening of enforcement on labor antitrust issues going forward. Our recent blog post delves into the FTC’s complaint and proposed consent order, and outlines key takeaways from the case. Visit our website to read, “FTC Tackles First No-Poach Case in Vertical Contracts,” authored by partners Lee Berger and John Kavanagh, and law clerk Jiyoung Lim: https://lnkd.in/eY6pws7b
