As U.S. District Judge Josephine Staton prepares to sentence Tom Girardi, a pivotal question emerges: should he serve time in a medical facility or prison? Justin Danilewitz, a former federal prosecutor who now chairs Saul Ewing LLP’s white collar and government enforcement practice, said Girardi’s lawyers have the better argument on the 4244 hearing. “The defense makes a very compelling argument for him to serve his sentence in the facility where he’s currently housed,” Danilewitz, a partner in Philadelphia, said. “This is not somebody who’s a threat to anybody anymore. What was particularly compelling was the line in the defense brief, ‘The court is not sentencing the memory of Tom Girardi. As the sentencing hearing for disbarred attorney Thomas Girardi approaches, observers speculate he may receive a prison sentence despite his declining health and advanced dementia. Aloke Chakravarty, a formal federal prosecutor and current Saul Ewing LLP partner in Boston, told Daily Journal Corporation that he thinks Girardi's case evokes a sentencing dilemma that is "not that common" because any decision will likely be influenced by a recognition from both sides about who Girardi is and his current state, rather than the crime itself. "It's very true to the government in their sentencing materials to try and preempt the signal that they recognize he is old and has mental deterioration, but it's not so significant that he should not face ultimately what is a high end of the guideline sentence," Chakravarty said. Earlier this month, Saul Ewing LLP's Miami Office had the privilege of participating in a team-building house decoration event at His House Children’s Home, a nonprofit organization dedicated to providing healing and hope to children from newborn to 18 years who have been removed from their homes due to abandonment, abuse, or neglect. The 5th Circuit Court of Appeals recently struck down a Nasdaq rule that would have required companies listed on the stock exchange to make disclosures about the race, gender and sexual orientation of their board members. Michael Gold, co-chair of the corporate practice at Saul Ewing LLP, said the appeals court's ruling will likely fuel cynicism about how the courts operate. He pointed out that a three-judge panel on the 5th Circuit — comprised entirely of judges appointed by Democratic presidents — had upheld the Nasdaq rule in an earlier ruling. That ruling was appealed to the entire 5th Circuit, where a majority of the judges were appointed by Republican presidents. "I would say it's a prime example of why so many people think the courts are controlled by politics, rather than by law," Gold said.
