The United States Patent and Trademark Office has announced significant changes to the patent fee schedule which will take effect on January 19, 2025. The final rule does not include some of the new fee structures proposed in April 2024, but still could have a significant impact on design patent practice, continuing application practice, and Information Disclosure Statement practice. On December 22nd, Panitch Schwarze attorney Jeffrey Gluck, Ph.D. will deliver a poster presentation titled “U.S. Copyright Law and Generative AI for Software Code” at the Biannual Cyber Conference. The presentation will focus on generative artificial intelligence programs that are capable of generating software code based on prompts entered by users. Labels won’t save you when the substance indicates otherwise. That’s the message the Court of Appeals for the Federal Circuit reiterated earlier this week with a decision in Crown Packaging Technology v. Belvac Production Machinery. If you watch Dr. I.P. carefully, you’ve probably heard that an offer for sale more than a year before you file your first patent application can prevent you from obtaining a patent on your invention.  An “offer for sale” is interpreted as a binding commercial offer – one which would create an enforceable contract for sale upon acceptance of the offer by the other side. In Crown, the “offer” in question was labeled as a “quotation.” A price quote is not typically considered a commercial offer for sale in the sense provided under patent law. However, looking deeper at the terms, the court concluded that, in spirit, it was actually an offer for sale. Crown tried to argue that the “quotation” was subject to Crown’s written acceptance of an order, and therefore acceptance by the other side was not sufficient to create a binding contract. But the Court found that further terms in the letter (including obligations and suggestions that performance would commence with receipt of the order) and Crown’s behavior with similar orders (Crown would send back order acknowledgements rather than written acceptance) to show that, as a whole, the letter was a commercial offer for sale under the law.
