Emma Weibel is one of the young Californians leading Genesis v. EPA. Last month, she gave a compelling speech at the World Design Policy Conference on policy, law, and the impacts of being a youth plaintiff in a federal climate lawsuit. In Genesis v. EPA, Emma and her fellow youth plaintiffs seek to hold the EPA accountable for discriminating against them as children by discounting the economic value of their lives and futures when it decides whether and how much climate pollution to allow. The United States Constitution protects their rights to equal protection of the law, life, and a life-sustaining climate. As Florida’s energy sector remains overwhelmingly gas dependent, the plaintiffs argue that the PSC has a constitutional obligation to prioritize clean energy alternatives, such as solar, wind, and battery storage, which are economically viable and increasingly accessible. Following Judge Seeley’s historic Held v. Montana ruling—a sweeping decision entirely in favor of the 16 youth plaintiffs—the state of Montana appealed to its highest court. Earlier this year, the youth plaintiffs appeared before a panel of judges at the Montana Supreme Court defending Judge Seeley’s groundbreaking decision. They’re awaiting a ruling any day! Judge Seeley’s landmark ruling affirmed Montanans’ constitutional right to a clean and healthful environment and compelled the state to consider impacts to its youth and account for greenhouse gas emissions when permitting fossil fuels.
