O’Hagan Meyer Partner Dean Falavolito, with associates Alexandra Boyer and Aaron Walayat assisting, was successful achieving dismissal of a Pregnancy and Gender Discrimination case filed in the United State District Court for the Eastern District of Pennsylvania. The plaintiff in the case claimed that the O’Hagan Meyer client discriminated against her in that following her return from pregnancy leave, that she was not permitted break times to express breast milk and was ultimately fired because of this request. O’Hagan Meyer was able to build a comprehensive record showing that the client terminated the plaintiff because of a medical error and that it had otherwise fully accommodated the plaintiff. The Court, citing the FLSA, the Pregnancy Discrimination Act, and Title VII of the Civil Rights Act agreed with O’Hagan Meyer’s argument and dismissed the plaintiff’s claims in their entirety. Way to go team with the great win for our Pittsburgh office!

On October 3, 2024, the Federal Circuit opened the door to false patent claims under the Lanham Act in Crocs, Inc. v. Effervescent, Inc., No. 2022-2160. Following this decision, product designers, manufacturers, and retailers should review and potentially revise their marketing strategies and product claims to ensure compliance with the Lanham Act, avoiding misleading assertions of patent status and product characteristics. O’Hagan Meyer partner James Cosby and associate Theo LaRose, both of the firm’s Richmond office, achieved the rare result of a dismissal of claims in arbitration, brought by a member of a professional organization against the organization, its officers and other members. The defense ruling defined the scope of a by-law provision that required the arbitration of certain claims regarding the organization’s business. The arbitration panel agreed with our team's position that such a provision did not apply to personal claims brought by the member. The panel further agreed with them by holding that the member’s claims were to be dismissed because the damages sought were generally unrecoverable in personal tort claims of the kind brought against the company.
