A criminal record expungement takes away the ability to publicly search your arrest record and gives you a fresh start. Once your record has been expunged, the law allows one to say it never happened. In PA, you may petition to expunge arrests & non-convictions if: • You were found not guilty. • Your charges were dismissed. • Your charges were withdrawn. • You were accepted into the ARD program, completed all terms and conditions, and paid all fines and costs. • You received Probation Without Verdict under the Controlled Substances Act. • You were a 1st-time DUI offender and successfully completed the ARD Program. • You were charged as a juvenile. • You had an underage drinking conviction (once you turn 21). • You’re 70 years or older and haven’t been arrested in 10 years. • You pled guilty to a summary offense more than five years ago and have a clean record since the offense. • You were charged with an alcohol-related offense and have met all the terms and conditions of the sentence imposed. The Community Accountability Program (CAP) is a voluntary diversionary program at the magisterial district court level offering first-time offenders of minor criminal offenses an alternative to trial and a criminal record. In CAP Program, defendants appear before the panel who set specific obligations. If these are met, charges are dismissed, and the defendant avoids a criminal record. The theft of Amazon packages and other deliveries from front stoops and porches became so prevalent in the last decade that a name for a new type of criminal activity entered the lexicon: Porch Piracy. While theft is already a crime, Act 41 creates a new offense of theft of mail with enhanced penalties for offenders, including a third-degree felony punishable by up to seven years in prison for repeat offenders convicted of stealing packages worth more than $2,000. Do you know about Pennsylvania's Social Host Law? In PA, you have a duty as a host to prevent minors from gaining access to alcohol on your premises. If an underage guest consumes too much alcohol at your party and then is involved in an accident, you can be held liable for the accident.
