  • The U.S. Department of Justice has filed emergency motions for a stay pending appeal of a recent district court order that preliminarily enjoined enforcement of the Corporate Transparency Act (CTA). If a stay is issued pending appeal, the CTA and its January 1, 2025 reporting deadline could become enforceable once again.

  • Certain individuals within large corporations, tasked with protecting their companies’ financial and reputational well-being, may face personal exposure if the organization fails to maintain adequate corporate compliance. Washington, D.C. partners David Ware and Michael Scanlon, along with Denver of counsel Allison Kostecka, discuss recent trends and enforcement developments affecting gatekeeper liability, best practices for in-house gatekeepers, and special topics for gatekeeper consideration. https://lnkd.in/epeErRKg

  • New York partner Shukie Grossman, Global Chair of our Investment Funds Practice Group, is a featured Lexology Index thought leader. Shukie recently spoke with the publication about what he feels is most rewarding about his work in private funds and the achievements he is most proud of, how AI and machine learning will impact private fund management and strategy development, economic volatility as one of the main challenges being faced by fund sponsors today, and how the regulatory landscape will evolve for private funds in the next few years. On the latter point, Shukie noted Gibson Dunn’s recent successful challenge to the new SEC rules that would have changed the way private funds and their sponsors are regulated.   Shukie went on to point out that clients look for private funds lawyers who are “well-versed in both applicable law and market practice, highly knowledgeable of their clients’ businesses and hyper-responsive” and that, to become successful, young lawyers should “find ways to meaningfully connect” with clients and colleagues and should constantly expand their knowledge and understanding. “There’s always more to learn no matter how long you’ve been practicing.”

  • Our Los Angeles partner Michael Farhang and Washington, D.C. partner Patrick Stokes and of counsel Pedro Soto analyze anti-corruption enforcement and developments in Latin America, including recent U.S. Foreign Corrupt Practices Act and locally led enforcement actions. They also outline noteworthy legislative and judicial developments and potential mitigation strategies for businesses operating in the region.   https://lnkd.in/gYJSyx8p
