In a holiday surprise, the #FCC’s Enforcement Bureau directed 2,411 companies to cure deficiencies in their Robocall Mitigation Database (RMD) certifications or explain why their certifications should not be removed. The deficiencies are due to lack of required information and robocall mitigation plans. Removal would require other providers to stop accepting calls from these companies. There are two important exceptions to the TCPA’s DNC rule of which callers should be aware. One involves the called party’s prior express invitation or permission. The other involves having an established business relationship with the called party. The Telephone Consumer Protection Act allows for autodialer and prerecorded calls to be made to a called party that provided his or her consent. But, consent is not always a surefire defense in a TCPA case.
