Recently, singer-composer Morrissey claimed that guitarist Johnny Marr registered the trademark for "The Smiths" without consultation, sparking a highly public disagreement that made it to countless music-specific magazines and websites. This situation brings to light the complexities of trademark rights and ownership, especially concerning collaborations. Regarding the Smiths trademark, Marr's management said that, in 2018, "Marr reached out to Morrissey, via his representatives, to work together in protecting The Smiths' name." Morrissey apparently did not respond to Marr, which led the latter musician "to register the trademark himself." The trademark THE SMITHS has been registered with the UKIPO since 2018, owned by NV Official TM Limited—Marr's company. For businesses, startups, and creatives, this serves as a cautionary tale.   • Just when we thought the saga of the Duchess's trademark challenge had reached its climax, the plot thickens! A quick refresher for those who missed our previous discussion: Meghan Markle's brand, "American Riviera Orchard," faced scrutiny under the sharp eyes of the USPTO for being primarily geographically descriptive. A hurdle, yes, but merely one step in what's proving to be an intriguing journey. 🍐 Enter Harry & David. The renowned holiday-pear purveyor has looked over the fence and said, "Hold on a minute." They've filed a letter of protest with the U.S. Patent and Trademark Office, pointing out what they perceive as a too-close-for-comfort resemblance between the Duchess's business name and their own "Royal Riviera" line. Their argument? A "likelihood of confusion" among the consuming public if the Duchess's trademark sails through unchallenged. But how will Harry & David's letter of protest affect the "American Riviera Orchard" application? A letter of protest is a great tool for members of the public to draw the USPTO's attention to potential conflicts while an application is under review. But letters of protest are not binding and it's up to the discretion of the USPTO whether to make a letter of protest part of the examination record for a trademark application. A letter of protest may also signal that Harry & David is preparing for a future opposition proceeding if Meghan Markle's application does end up moving forward toward registration!
