Western District of Washington Dismisses Jones Act Case, Upholding Forum Selection Clause in Foreign Crewmember’s Employment Contract Collier Walsh Nakazawa LLP is proud to have assisted a prominent ship operator and its technical office with the successful enforcement of the forum selection clause in a seaman’s employment agreement before the Western District of Washington. Thanks to the efforts of our Seattle team, particularly Anusha Pillay and Zachary Farley, our clients achieved dismissal of a complaint filed by a foreign seaman who alleged injury while at sea. Despite the terms of an enforceable employment agreement, the seaman’s receipt of immediate medical care when he arrived in Seattle, and his ongoing care in his home country, he brought an action attempting to seek remedies before the federal courts of Washington. The Western District upheld the forum selection and choice of law clauses in the seaman’s contract and ruled favorably on our clients’ Motion to Dismiss for Forum Non Conveniens. The Court agreed that the seaman’s home country was the appropriate forum for the dispute. Our clients’ success was a truly global endeavor that required us to reach out to our international network of experienced, knowledgeable maritime attorneys to provide interpretations of the maritime laws of Ukraine and Canada (Montreal, in particular).
