On October 31, 2024, the U.S. District Court for the Eastern District of Virginia proposed an amendment to Local Civil Rule 7, which governs general motion practice before the Court. On December 1, 2024, the amendment took effect. The result was the deletion of Rule 7(k) from the Local Civil Rules that instructed opposing counsel to comply with Roseboro v. Garrison by including warning statements in dispositive motions addressed to pro se litigants. In a significant recent decision in Infrastructure Services v Spain; Border Timbers v Zimbabwe, the England and Wales Court of Appeal has held that States may not oppose the registration of ICSID awards in the UK on the basis of state immunity. While States enjoy general immunity from proceedings in the UK courts, the States’ accession to the 1965 ICSID Convention constitutes an express waiver of sovereign immunity with respect to the registration (though not execution) of ICSID awards.
