Founded by Ben Bailey and Brian Glasser in 1999 in Charleston, West Virginia, Bailey Glasser has grown to over 90 lawyers across the United States. The firm’s complex litigation practice focuses on high-stakes commercial litigation; class actions for consumers, insureds, investors, and retirement plan participants; catastrophic injury and defective product cases; antitrust; and whistleblower lawsuits.   • This month is National Impaired Driving Prevention Month, designed to help reduce drunk and drugged driving during this festive season. Alcohol is the biggest cause of traffic fatalities, with drunk driving killing an average of 28 people every day across the U.S. More than 21 million instances of drunk driving on U.S. roads are expected during the holiday period between November 1 and January 1, a 40% surge, according to the National Highway Traffic Safety Administration. As we celebrate during this holiday season, here are some tips to ensure we all arrive safely at our destinations: • Plan ahead: If you plan on having even one drink, make transportation arrangements before going out. Buzzed driving is impaired driving. • Arrange for a rideshare or use public transportation – and many communities have sober ride programs available during the holidays. • Pledge to never drink and drive, and if you are the designated driver, commit to 100% sobriety. • Like drunk driving, drug-impaired driving is illegal in all 50 states. • When you’re the designated driver, enjoy some “mocktails” or non-alcoholic holiday beverages, which are happily becoming more commonplace at bars and restaurants – and parties – across the country. • If you planned on driving sober but are honestly not able to, ask for help in getting you and your friends/family home.   • According to the U.S. Consumer Product Safety Commission, emergency rooms treated roughly 231,700 toy-related injuries in 2023, with at least 10 toy-related deaths among children aged 14 and younger. As you finish holiday shopping, Safe Toys and Gifts Awareness Month reminds us to consider whether the toys we plan to give are appropriate for their recipients. This event raises funds for local nonprofits, including Sophia’s Collection in Memory of Penny Mossor, their family’s fund. At Celebration of Decorations, JCCF’s existing funds create Christmas-themed items for a live auction. Each year, Sophia’s Collection contributes a beautifully decorated tree—like the one pictured here. Founded in memory of Penny Mossor, Nic’s mother who passed away in 2019, and named after his daughter, Sophia’s Collection is dedicated to fostering community growth by: - Partnering with schools to fund educational resources, equipment, and programs. - Supporting community projects that enhance local development and well-being. - Providing financial relief to grandparents serving as primary caregivers, helping create stable, supportive environments for families. Recent contributions include donations to Ripley High School’s renovation project and plans to support Fairplain Elementary’s playground renovation.   • As we shared in our client alert last week, on December 3, 2024, the U.S. District Court for the Eastern District of Texas issued a nationwide preliminary injunction in Texas Top Cop Shop, Inc., et al. v. Garland, et al., temporarily halting enforcement of the Corporate Transparency Act (“CTA”) and its beneficial ownership information (“BOI”) reporting requirements. In response, FinCEN announced it will comply with the Court’s order for as long as it remains in effect, noting that during this time reporting companies are not currently required to file BOI reports and will not face penalties for failing to report while the injunction remains in effect. Voluntary submissions, however, are still permitted. What This Means for You: • No Immediate Filing Requirement: The preliminary injunction stays all BOI reporting requirement deadlines for now. Reporting companies are momentarily relieved of reporting obligations. • Litigation Ongoing: As expected, the Department of Justice filed a Notice of Appeal on behalf of the Department of the Treasury, signaling the government’s intent to challenge the court’s decision. The ultimate status of the injunction and the CTA remains uncertain, pending further court rulings or guidance. • Preparation Still Recommended: While filing is currently paused, reporting companies should nevertheless continue assessing their BOI reporting requirements and gathering necessary information to ensure readiness if the injunction is lifted. FinCEN has not yet provided guidance on how much time reporting companies will be granted to file their BOI reports if the Texas District Court’s injunction is lifted and how quickly enforcement of the CTA would resume.   • December 10th is International Human Rights Day, commemorating the anniversary of the Universal Declaration of Human Rights (UDHR), first proclaimed by the United Nations General Assembly on December 10, 1948. This landmark document enshrines the inalienable rights entitled to every human being, regardless of race, color, religion, sex, language, political opinion, national or social origin, property, birth, or other status. While not legally binding, the UDHR has inspired the creation of more than 60 human rights instruments, including the Convention Against Torture, the Genocide Convention, and the Convention on the Elimination of Racial Discrimination, among others. Its principles have laid the foundation for an expanding system of human rights protections, which are increasingly vital as equality rights face challenges such as global healthcare crises, ongoing global conflicts, and the realities of climate change. The theme for Human Rights Day 2024 is "Our Rights, Our Future, Right Now." This theme emphasizes the role of human rights as a pathway to solutions, serving as a preventive, protective, and transformative force for good. It calls for acknowledging the importance and relevance of human rights in our daily lives and mobilizing action to reinvigorate a global movement for human rights. In line with this theme, the United Nations High Commissioner, Volker Türk released a short video discussing the role human rights policies play as a preventative, protective, and transformative force for people in every corner of the globe.
