All Freelance Writing

I've noticed a worrying trend targeting freelance writers on job boards: ads for "volunteer freelance writers." First, let's be clear. If you're "freelance," you're being paid. You're not a volunteer. Let's be equally clear that it is 100% OK for writers to take on volunteer work. Here's what's not OK: - Targeting freelancers (a type of paid professional) in ads seeking volunteers - For-profit companies posting ads asking for unpaid labor As someone with experience in both nonprofit volunteer recruitment and both nonprofit and freelance hiring, there are better places to recruit volunteers. And you can, and should, be able to do that without devaluing professionals seeking genuine paid roles. The latter issue is a bigger one. It's worker exploitation, and it is not OK. If you see these ads as a freelance writer, run. These aren't companies that respect you. Also understand that "nonprofit" doesn't inherently mean "non-paying." Nonprofits often have paid staff, and they often hire paid contractors and/or temporary employees (such as to run specific campaigns). Volunteer work can be admirable, and it can even provide newer writers with early clips. But it's not your only option if you want to put your professional skills behind a cause or organization you care about. If you do want to take on volunteer work, here are a few tips and suggestions: - Volunteer for legitimate nonprofit organizations you would choose to volunteer with anyway (registered nonprofits, not things like writing for a company that simply claims they aren't earning profits yet). - Don't do that volunteer work during working hours. Treat it the same way you would treat any non-writing volunteer work. Leave your working time for paying clients, marketing your services to paying clients, or building additional income streams. - Certainly not a requirement, but my recommendation is to focus volunteer work for smaller nonprofits that genuinely need the volunteers over larger organizations that do, or should, have budgets to hire professionals. As always, make decisions that are right for you, both personally and professionally. But please be careful out there. I'm seeing more and more shady "job ads" that amount to little more than for-profit companies soliciting free labor. #freelance #jobs #FreelanceWriting

You're a freelance writer. You come across a publisher's job posting looking for a freelancer. But then you notice something unusual. The job ad mentions you'll have to work under a W2 contract through an agency (rather than the typical 1099 independent contractor role freelancers fall under). Why might this concern you? (And it should.) First, when you work under a W2 contract in this way, you're technically not working as a freelancer even though the client might still refer to it as freelance work in their job ad. In this situation, you're no longer self-employed. Instead, you're an employee of the agency the end-client works with, and that agency has a contract with the publication to provide writers. It's similar in that the role can be limited in scope like with freelance work. But there are some big downsides to accepting this kind of work or mistaking it for freelancing. Here are two examples: 1. Your business expenses are tax deductible as a freelancer. For work you do as a W2 employee of an agency, that might not be the case. 2. As an independent contractor, you retain your copyright in your work by default. For a client to obtain copyright, you have to sign a specific work-for-hire agreement or other formal copyright transfer. When you write for an employer under W2 status, you're more than likely automatically giving up your copyright. That last one is particularly important if you're a specialist, or if you're used to writing for publications where copyright transfers aren't the norm (you might sell first North American rights or some other set of rights instead). As a specialist, you'll often write similar things for different clients, and not retaining your copyright puts you at risk of creating what a client or employer considers an unauthorized derivative work. Now, I'm not a lawyer. This isn't legal advice. But I do advise you strongly to research W2 vs 1099 contracts if you're a freelance professional based in the U.S. Pay close attention to job ads to make sure you don't accidently give up rights or complicate things for yourself in the future. Look at how it will impact your intellectual property rights, your taxes, your self-employed retirement savings and limits, etc. A publisher making this changes is doing it to protect themselves.
