PBM reform is on the table in Congress and it’s a big deal for employers, employees and the entire health care industry. As part of the year-end federal spending bill, lawmakers are taking action to create a fairer, more transparent PBM system that will reduce drug costs and protect consumers. Here’s what’s coming: • 𝗘𝗹𝗶𝗺𝗶𝗻𝗮𝘁𝗲 𝗦𝗽𝗿𝗲𝗮𝗱 𝗣𝗿𝗶𝗰𝗶𝗻𝗴: Currently PBMs can charge health plans more for a drug than they pay pharmacies and keep the difference. The reform will end this practice and employers and patients won’t pay more than they should. • 𝗥𝗲𝗯𝗮𝘁𝗲 𝗣𝗮𝘀𝘀-𝗧𝗵𝗿𝗼𝘂𝗴𝗵𝘀: Ever wonder where those manufacturer rebates go? Spoiler: they don’t always go to the consumer. The new rules will require PBMs to pass rebates directly to plan sponsors, which will mean real savings for employers and employees. • 𝗗𝗲𝗰𝗼𝘂𝗽𝗹𝗲 𝗣𝗕𝗠 𝗖𝗼𝗺𝗽 𝗳𝗿𝗼𝗺 𝗗𝗿𝘂𝗴 𝗣𝗿𝗶𝗰𝗲𝘀: When PBM profits are tied to the list price of the drug, no wonder prices stay high. These reforms will separate PBM earnings from drug prices and remove the financial incentive to keep prices high. These changes have the potential to be a big win for employers dealing with rising health care costs and employees struggling to afford their medications. This Wall Street Journal article highlights a critical flaw in our health care system: the enormous disparity in prescription drug prices, driven by a system where middlemen profit while American families and businesses bear the cost. The article revealed staggering examples of drug pricing inconsistencies: -Medicare drugs with prices that range by thousands of dollars depending on the plan and location. -Generic prostate-cancer drugs that cost $815 in one county but surge to $3,356 in another. -Seniors forced to dip into retirement savings or find part-time jobs just to afford life-saving medications. This isn’t just an isolated issue affecting public safety nets like Medicare—it’s a broken, profit-driven system that impacts private markets too. Patients are paying more than they should while losing access to some of the care they need. 𝐈𝐭’𝐬 𝐜𝐨𝐬𝐭𝐢𝐧𝐠 𝐮𝐬 𝐢𝐧 𝐦𝐨𝐧𝐞𝐲, 𝐚𝐜𝐜𝐞𝐬𝐬, 𝐚𝐧𝐝 𝐡𝐞𝐚𝐥𝐭𝐡—𝐚𝐧𝐝 𝐢𝐭 𝐬𝐡𝐨𝐮𝐥𝐝𝐧’𝐭 𝐛𝐞 𝐭𝐡𝐢𝐬 𝐰𝐚𝐲. In 2022, Americans abandoned 94 million prescriptions because they couldn’t afford them. For every $1 increase in a drug’s list price, patients paid $2.09 more out of pocket—while pharmacy benefit managers (PBMs) pocketed larger rebates. Congress needs to take action to stop the three big PBMs, which control 80% of the market, from driving up costs, forcing patients into their own high-priced pharmacies and putting local pharmacies out of business. The solutions are simple and ready to implement: -Full transparency in PBM pricing and rebate practices. -Delinking PBM compensation from drug prices to remove incentives for higher costs. -Sharing negotiated savings directly with patients at the pharmacy counter The evidence is clear, and bipartisan support for reform exists. Yet Congress has failed to act. Each day of delay costs families, businesses and local communities millions. With just weeks left in this legislative session, Congress must pass PBM reform now. Patients cannot afford another year of price-gouging and abandoning prescriptions.
