Every barrister, from pupil to KC, knows that their online conduct can significantly affect their professional reputation. What's more, the Bar Standards Board (BSB) has made it clear that even personal social media activity may be regulated if it could impact the legal profession. In her new article for Counsel (the Magazine of the Bar of England and Wales), our legal expert Julie Norris provides a reminder of social media pitfalls and suggests what to do if you’ve pressed ‘post’ in the ‘heat of the moment’ https://lnkd.in/eXQb5Tm9

As we approach the Christmas party season, there is always the risk of someone taking things too far, especially where the drinks are flowing. This year more than ever, behavioural misconduct is high on the ICAEW’s priorities. Its new Code of Ethics will be published in early 2025 and it is putting behaviour towards colleagues, clients and contractors – both inside or outside of the office - at the top of its agenda. With this in mind, our regulatory and investigation experts Julie Matheson and Caroline Day offer their best practice guidance to #accountancy firms on how to conduct an investigation in the event of allegations of misconduct. https://lnkd.in/gH3qwZf2 #accountants

The SRA recently released its finalised guidance on internal investigations and a suite of guidance for in-house solicitors. The guidance on investigations covers matters such as the relevant regulatory framework, acting with independence and circumstances in which the SRA must be notified. Developed with extensive feedback, this guidance empowers solicitors to navigate challenges, uphold ethics, and add value to their organisations. The guidance for in-house solicitors, including on legal professional privilege when working in-house and on reporting concerns about wrongdoing, are also welcome developments. The current regulatory framework for psychotherapists and counsellors has come under increasing scrutiny recently, following a series of claims of abuse by patients. While these incidents are fortunately very rare and do not reflect the vast majority of the profession, it raises the question as to whether mandatory statutory regulation would address patient concerns and enhance their safety. In their new blog our legal experts Shannett Thompson and Zoe Beels look at the main challenges and facing the industry’s regulators. https://lnkd.in/epbBFCkH #pyschotherapy #counselling

Our legal experts Shannett Thompson and Zoe Beels explore the key regulatory considerations for practising doctors in light of the proposed reforms. How should lawyers and law firms think about client selection? Should lawyers be accountable for decisions they make about who they act for? Earlier this month, Julie Norris and Steven Vaughan interviewed Brad Wendel (Professor of Law at Cornell Law School and one of the world’s leading legal ethics scholars) at UCL Faculty of Laws about his latest book “Canceling Lawyers – Case Studies of Accountability, Toleration, and Regret”.
