The High Court has ruled in favour of our client in his application for permission to proceed with a surrogacy arrangement using the last remaining embryo created with his late wife’s eggs, notwithstanding the fact that his wife had not provided written consent for such use. The application was brought in reliance on the European Convention on Human Rights (given effect in domestic law by the Human Rights Act 1998). This follows from the case of Jennings -v- Human Fertilisation and Embryology Authority [2022] EWHC 1619 (Fam), in 2022 in which our Life Sciences team also acted for the successful applicant.
