Many self-employed and freelance workers don’t think lenders will treat them fairly. Many of the mainstream lenders simply don’t cater with complex criteria to compliment the variety and variations found in this market, that’s where specialist lenders can really shine. In this session we will look at how lenders assess and interpret self-employed accounts whilst also showing you how our criteria can help support you with 1 years trading, retained profits, using accountant projections, last year’s figures or using an average. If you are looking to commit mortgage fraud, please do not approach me as a mortgage adviser ✋ Mortgage fraud is a serious crime, lying on a mortgage application is a criminal offence and can lead to a maximum prison sentence of up to 10 years. I am fortunate to have a fantastic & supportive compliance team at PRIMIS Mortgage Network that I can speak to if I have any concerns. Some common types of mortgage application fraud are: False income/ employment. This is a common fraud type seen by brokers and lenders. This involves manipulation of the applicant’s genuine source of income or fabrication of a false primary or secondary employment to circumvent lender affordability criteria. These are usually supported by false or altered documentation and can be poor quality. Credit abuse. Non-disclosure of adverse credit which may affect the ability to borrow. I request multi credit agency reports as a min with every client upfront before we talk any maths. Scheme abuse. Where a borrower conceals their intentions for the property following purchase to obtain a mortgage that would otherwise be unavailable. This can be when a buy2let product is used to purchase a property that the borrower resides in. Conversely, we also see instances where a residential mortgage product is used to purchase a property that has subsequently let without consent from the lender. Deposit fraud. This occurs when the source of the deposit cannot be substantiated. For example, if the source of deposit funds has been derived from an unacceptable source and can be indicative of 100% lending.

Although it may be unlikely, you may have the opportunity to engage in negotiations with the collection agency to remove negative information from your credit report by agreeing to pay the debt through a pay-for-delete letter. Collection agencies generally seek payment for the outstanding debts they are managing, so some agencies might consider removing the collection account from your report if you make a payment. April brings in the new tax year, as well as a hope for warmer, drier spring weather (fingers crossed). But it has also brought in another increase to the applicable cap for complaints referred to the Financial Ombudsman Service (FOS) on or after 1 April 2024. The FOS’s jurisdiction allows it to award financial sums, interest, costs as well as directing businesses to take certain steps, based on an assessment of what it considers to be fair and reasonable. That is all at no cost to the customer, and possibly without a basis in law. Once a Debt Management Plan is discharged, it can be considered in mortgage subject to any of the following conditions depending on the lender: It Will need to be completed over 6 years and subject to credit score. up to 95% none in last 3 years and satisfied for at least 3 years up to 80% none in last 2 years and satisfied for at least 1 year Some lenders can consider ongoing DMP up max Loan-To-Value 70% It is also important to note that the type of debt that was included in the DMP and the length of the DMP will also be considered. The Bank of England and Financial Conduct Authority have published the response to the DSS consultation paper and updated guidance for participants. We have introduced several changes based on the feedback received, including: • More flexibility to firm-level limit allocations, with additional review points for firms to progress. • More proportionate minimum capital requirements to encourage start-ups to join the DSS. • Expansion of eligible assets to include non-GBP denominated securities. • The introduction of a regular discussion forum for DSS entrants and regulators. The Association of Short Term Lenders (ASTL) has joined the growing wave of voices opposing proposals by the FCA that would enable the regulator to name firms it is investigating at the outset of the investigation. As part of its recent consultation paper, CP24/2, Our Enforcement Guide and publicising enforcement investigations – a new approach, the FCA has proposed identifying firms at the outset of an investigation, using a ‘public interest’ framework, providing the firm with 24 hours’ notice that it is doing so. There has already been a significant and robust response to the proposals, with a letter signed by 16 trade associations, including UK Finance and the City of London Corporation, saying they “have an unduly negative impact on the reputation on firms”. https://lnkd.in/eJy3ayzS
