CONVEYANCING TIP OF THE WEEK An agreement of sale may sometimes lapse if the suspensive conditions contained therein have not been timeously fulfilled. A suspensive condition cannot therefore be waived or extended subsequent to its expiry date. The agreement cannot be revived by way of an addendum signed by the parties.  It is therefore necessary for the parties to enter into a new agreement. The new agreement can be on the same terms and conditions as the original agreement provided the suspensive condition has been amended. An agreement cannot be revived without amendments as it would automatically self-destruct as a result of the non-fulfilment of the condition that brought about its demise in the first place. If you want to build constructive relationships with Conveyancers, don't patronise or talk down to them, especially given the pressures they work under and the incalculable value of their collective contributions to society. CONVEYANCING TIP OF THE WEEK It often happens that immovable property maybe have been registered in the name of both spouses who have subsequently divorced. In an uncontested divorce, the parties will conclude a settlement agreement whereby the proprietary consequences of the marriage are dealt with.  Transfer pursuant to a divorce order is effected in terms of Section 45 of the Deeds Registries Act. If there is a bond on the immovable property, the bond will also be endorsed to reflect the substitution of the debtor under the bond.  No transfer duty is payable on the transaction. People keep on asking me, how did you pass the Conveyancing & Notary Exams? Ask yourself, how bad do you want it? Is it something you are obsessed about? How badly you want it will determine whether you'll realize your dream because how bad you want it determines what will make you quit. Burning desire allows a person with average ability to successfully compete with those who have far more ability. Desire allows you to give it everything you've got. It helps you reach your full potential. If your dream is not an obsession, as soon as you come across obstacles, you'll quit. Success is not convenient, trust me. In order to succeed you will need to inconvenience yourself in a big way, for a long time. That's why it is important to be driven, disciplined, excited and passionate about your dream. If your "why" is big enough, the "how" will take care of itself. Do a lot of repeating, repetition creates a Master.

Sometimes it is right for practitioners to question adverse changes being forced on them, and not just the flawed TA6 form. First I would never call anyone a "dinosaur" merely because they are sceptical or critical of change. After all, change can be a good thing or a bad thing, or even a mixed blessing. And sometimes changes don't go ahead or are modified because the proponents yield to the good sense of those who can see the downsides of what was proposed. But to press ahead with change which is opposed by most practitioners is the height of madness. That said, I also acknowledge that change can sometimes be painful for some in the short term but beneficial over time and that opinions can vary across the profession on a range of issues. And I am NOT seeking to be critical in principle of anyone who tries to engineer changes that are for the collective benefit of the profession. But after the events of recent years that have caused many to depart the profession, e.g. stamp duty holiday, surely property lawyers deserve a breather! #conveyancing #conveyancers #propertylawyers

📝 Claimants in professional negligence cases may wish to join forces under a single Claim Form to limit initial court fees and spread the risks and costs of the litigation between themselves. 👥 There are various ways to bring multi-party proceedings under the CPR, including representative proceedings under r.19.8 and Group Litigation Orders under r.19.21. Further, per r.19.1, “any number of claimants or defendants may be joined as parties to a claim” and, per r.7.3, “a claimant may use a single claim form to start all claims which can be conveniently disposed of in the same proceedings.” These rules are often used to justify multi-party Claim Forms. 👨‍⚖️ The previous leading case on this was Abbott v Ministry of Defence [2023] EWHC 1475 (KB) where it was held that “if there are likely to be common issues of sufficient significance that their determination would constitute real progress towards the final determination of each claim”, then a Court could conclude that a single set of proceedings would be sufficiently convenient. With 75% of CILEX pros in SRA-regulated firms, the proposal seeks a unified standard for consumer protection. The SRA have launched their consultation on the handling of client money. This could have a big impact on conveyancing. My own opinion is that moving towards third party managed accounts, or settle ment platforms (or indeed some other model as detailed in the consultation) could be incredibly beneficial: reducing risk and associated costs for clients, lawyers and lenders.
