Optional wording covers whether to draft the provisions solely as warranties. When any new technology is developed - as we are seeing with AI - an important question is can it be legally owned and, if so, by whom? Put simply, if you can own technology (and enforce that ownership) then you can control its distribution, license it, and monetise it. Patents are often seen by many as the "holy grail" of IP protection for technology given the potential monopoly they confer. However, the relationship between software-based inventions and Patents is not straightforward. My colleague Antony Craggs has shared an article below on the current status of AI in the field of Patent protection - a key issue in the current landscape of rapid AI development.

The extraordinary amount of power and water consumed by an AI/crytpo service/data centre does not seem to be among the factors considered by the Bank of England/PRA (or indeed regulators involved in the Digital Regulation Cooperation Forum). Following an almost year-long review into artificial intelligence foundation models, and the publication of its initial report, the UK Competition and Markets Authority published an updated report and a fuller technical report outlining its growing concerns that competition in AI is not working as it should. As reported by POLITICO, the draft Digital Information and Smart Data Bill (the bill to amend the UK data protection regime) will be introduced into Parliament next week.
