If you have to look at commercial or financial contracts, in particular, force majeure clauses which contain reasonable endeavours provisos, read on.... In RTI Ltd v MUR Shipping BV, the UK Supreme Court unanimously overturned the split Court of Appeal decision and held that reasonable endeavours does not require a party to accept non-contractual performance (in this case payment in another currency), providing much needed clarity on this very fundamental point as a matter of principle. https://lnkd.in/euWvapN4

👋 The UK Government is consulting on the implementation of the new #subscription contracts regime under the Digital Markets, Competition and Consumers Act (#DMCCA). The new rules will apply to a wide range of #consumer contracts across a number of sectors - from digital and print content to subscriptions for organic veg boxes and coffee beans (and many other things in between). Basically anything where a consumer pays a recurring fee in return for goods or services and that contract is not for a fixed term.* ⚠ From our discussions with clients, implementation will be a complex process, with the need to make changes to IT systems and customer journeys to ensure that the correct information is provided pre-contract and prior to renewal, and to enable consumer rights to cancel. ❓ This consultation is important as it will shape the regulations that the Government makes under the enabling powers in the DMCCA. The Government is seeking feedback in a number of areas (the consultation document is 75 pages long so grab a ☕). 📆 The consultation is open until 10 February 2025. 💡 The consultation document is complex.
