The Information Commissioner's Office has asked the Upper Tribunal for permission to appeal against its loss against Clearview, Nadine Daher is reporting - but there was an astonishing delay between the First-tier Tribunal refusing permission to appeal and actually sending that decision to the ICO and Clearview. Administrative error might well be the most likely reason here, but it's worth noting that months-long delays aren't anything new in FTT data protection appeals. The Doorstep Dispensaree appeal took eight months from hearing to ruling; Experian took a year; Clearview took eleven months. By contrast High Court judges are expected to turn round judgments round in all but the most complicated trials in about 3 months. With the DUA (Lipa) Bill, the UK is now on its second post-Brexit attempt to overhaul the UK data protection framework. I find it surprising that neither the #DPDI nor the #DUA drafters considered whether the already over-stretched tribunal system is really the appropriate forum for these cases. 🚨 The ICO has lost its appeal against The First Tier Tribunal regarding an enforcement notice issued to Experian in 2020. The ICO had concerns over Experian’s data processing with regards to the GDPR’s transparency requirements however the First Tier Tribunal found that significant transparency was provided. The ICO then appealed and the Upper Tribunal has upheld the decision by The First Tier Tribunal. Commenting on the decision the ICO said: "The credit reference agency industry holds data on almost every adult in the UK. Information is screened, traded, profiled and enhanced to provide direct marketing services, and it is vital that this must happen in line with the law and in a transparent and fair way. "That is why this was an important appeal for us to make, accepting the valuable role of the Tribunal to provide scrutiny of our decisions. It is regrettable that the flaws identified by the Upper Tribunal did not extend to overturning the First-tier Tribunal’s judgment, but there is definite value on the clarity we have now received on several key points. “The ICO will take stock of today’s judgment and carefully consider our next steps, including whether to appeal." #dataprivacy #dataprotection #gdpr #compliance
