After the UK’s new Home Secretary Yvette Cooper gave a speech outlining some of the Labour government’s intentions when it comes to #Immigrationlaw – especially for #familyimmigration and #workvisas – Vanessa Ganguin #Immigration law’s Senior Associate Ben Maitland provided LexisNexis some news analysis summing up what we can surmise from the Labour government’s pronouncements on #UKimmigration so far. Home Secretary Yvette Cooper delivered a statement to the House of Commons which promised to keep most of the last government’s five point plan to reduce UK immigration, though the Minimum Income Requirement in the Family Immigration Rules currently set at £29,000 wouldn't rise any higher as planned while the Migration Advisory Committee reviews the financial requirements to bring family to the UK. Emojis are regularly used as visual 👁 and emotional 😃 signposts in modern-day communications, including workplace emails. 📩 However, local and international legal cases have shown those expressive tiny faces can sour relationships and business transactions, with courts ruling they can convey defamatory meanings, threatening behaviour and contract acceptance. Calculating holiday allowances can be tricky for any staff who work irregular hours. In an effort to simplify things, this year the government has introduced changes to the rules on holiday rights as part of reforms to some employment rights that developed from years of European and UK case law. 'These changes were made following consultation, with the stated aim of simplifying the rules on holiday entitlement and pay,’ says Sarah Everton, Head of the Employment Law team with Myers & Co. ‘They also address the potential unfairness of a Supreme Court decision that gave a term-time worker more holiday when compared to a someone who worked all year round for the same number of hours each year.’ In this blog post, Sarah Everton highlights what employers need to know about the changes and the importance of complying with the new rules. Here's a snapshot of the major parties' stances: 🔴 Labour aims for comprehensive reform in the first 100 days, including introducing day-one rights like protections against unfair dismissal, banning zero-hours contracts (with exceptions), enhancing sick pay, tackling "fire and re-hire," repealing anti-strike laws, and expanding flexible working rights. 🔵 Conversely, the Conservative Party's stance appears to lean towards deregulation, potentially reintroducing employment tribunal fees and capping non-compete clauses. A new practice direction is being issued for appeals heard in the First-tier Tribunal. It is a major development and any lawyers preparing or presenting appeals will need to read it carefully. For example, the practice direction limits skeleton arguments to 12 pages and expert reports to 20 pages. Permission is needed to exceed these limits.
