Labour's forthcoming Employment Rights Bill promises comprehensive reforms aimed at improving workplace conditions and workers' rights across the UK. Here’s a breakdown of the key changes: Day-One Rights Under the new bill, all workers will have protection against unfair dismissal from their first day on the job, impacting approximately 9 million people. This eliminates the current two-year qualification period. Day-one rights will also extend to unpaid parental and paternity leave, benefiting an estimated 1.5 million parents. Sick Pay The bill introduces universal sick pay from the first day of illness, removing the lower earnings limit. This change ensures that all workers, regardless of their earnings, receive statutory sick pay of £116.75 per week for up to 28 weeks. Probation Periods Labour proposes a statutory probation period for new hires, capped at nine months. This change, due to take effect in autumn 2026, aims to balance employee rights with business flexibility. Zero-Hours Contracts Over a million workers on zero-hours contracts will gain the right to guaranteed working hours after 12 weeks of regular work. Workers who prefer the flexibility of zero-hours contracts will retain the option to stay on them. Fire and Rehire Practices The bill largely bans fire and rehire practices, except in extreme cases where a business faces collapse. This reform seeks to prevent companies from reemploying workers on less favorable terms. Flexible Working and Gender Equality Flexible working will become the default where practical, and employers will be required to address gender pay gaps. There will also be enhanced protections for pregnant employees and those returning from maternity leave. New Enforcement Agency A Fair Work Agency will be established to oversee these rights, combining existing enforcement bodies. This agency will have authority over various workplace rights, including holiday pay. Minimum Wage Adjustments Labour intends to remove age bands in minimum wage rates, ensuring fair pay for younger workers and tying wage increases to the cost of living. While the bill marks substantial progress, Labour plans to introduce further proposals, such as measures against pay discrimination and the right to disconnect from work outside of hours. These reforms will take time to consult on and implement, with some provisions extending over two years.
