Before UK GDPR took effect the Information Commissioner's Office produced an infographic that contained 12 steps which organisations should take to prepare for its introduction. It was and remains a useful approach for determining your compliance status and can be used to structure policies and procedures. DATA PROTECTION AUDIT STATEMENT The Jersey Office of the Information Commissioner has published a statement following its data protection audit of an unnamed Jersey public sector data controller which processes significant volumes of personal data, including special category data, and had been the subject of complaints. Two key areas of non-compliance were identified as: ·      Technical and organisational measures to ensure adequate security over personal data held in electronic or manual form; and ·      Provision of data protection training and staff awareness of their data protection roles and responsibilities. Lessons learned included: ·      Confidentiality must be preserved with consideration given to office layout, privacy screens and areas of mixed use; ·      When sharing personal data, employees must be clear which lawful basis they are relying upon; ·      Data sharing agreements should be agreed and in place prior to any sharing; ·      Training should be specific and tailored to the staff role; ·      Policies and procedures should be effective, proportionate and available to all staff; and ·      There should be guidelines for the use of virtual meetings, recordings and messaging platforms so that staff know how to use these safely and maintain confidentiality. The audit also identified areas of good practice in the controller’s technical security measures (MFA-enabled devices, complex password requirements and the prohibition of the use of personal devices for work-related activities); it found that software systems had audit functions and appropriate, role-specific access controls; and that breach management procedures  were strong with the majority of employees saying they would feel comfortable reporting a breach. The lessons learned and examples of good practice may be relevant for all regulated and other businesses in Jersey to consider with reference to their handling of personal data. #JerseyCI #DataProtection

The ICO today launched a new audit framework designed to help organisations assess their own compliance with data protection law. With the intention being to help organisations identify necessary steps to improve their data protection practices and create a culture of compliance, it could be a valuable tool for small and medium sized businesses alike. Ian Hulme, ICO Director of Regulatory Assurance, said: "Transparency and accountability in data protection are essential, not just for regulatory compliance but for building trust with the public.
