Following a successful review by UKAS, the ICO approved LOCS:23 GDPR certification standard has been updated to include more detail regarding the certification process and certification mark. The new certification mark meets UKAS requirements and has a built in QR code that links back to the Certification Body register enabling consumers to verify certification claims. JSA Prism (Data Privacy) | Edition 3 | September 2024 Consent and Consent Managers   In the third instalment of the Prism series on the Digital Personal Data Protection Act, 2023 (“DPDPA”), we analyse the concepts of ‘Consent’ and ‘Consent Manager’. Consent is one of the fundamental concepts in a data protection legislation and we delve into the requirements of a valid consent under the DPDPA in this Prism. We have also focused on the concept of ‘Consent Manager’under the DPDPA and have enumerated the roles and responsibilities of these consent managers. 🚸Online safety and data protection- the collab! Update from UK interesting statement issued by regulators: Ofcom and the Information Commissioner's Office have published a joint statement on collaboration on the regulation of online services. The statement sets out how the two regulators we will work together on areas of mutual interest to ensure a coherent approach to regulation between the online safety and data protection regimes. The statement sets out 6️⃣ examples of Collaborative Themes 1️⃣🔞Age assurance – this refers collectively to approaches, including age estimation and verification, used to estimate or establish the age of a user so services can be tailored to their needs and protections put in place appropriate to their age, or to mitigate the risk of harms arising from the processing of the personal data of children. 2️⃣ 🤖 Recommender systems - recommender systems use algorithms to curate and determine the ranking of content that is suggested to users of online services based on data about their characteristics, inferred interests, and behaviour. The ICO’s Children’s code states that services should not use children’s personal data in ways that have been shown to be detrimental to their well being 3️⃣📱Proactive tech and relevant AI tools – under the Online Safety Act (OSA), ‘proactive technology’ refers to: (i) content identification technology, which analyses content to assess whether it is content of a particular kind; (ii) user profiling technology, which analyses relevant content, user data or metadata relating to relevant content or user data for the purposes of building a profile of a user to assess characteristics such as age; (iii) behaviour identification technology, which analyses relevant content, user data or metadata relating to relevant content or user data to assess a user’s online behaviour or paterns of online behaviour. 4️⃣🚷 Default settings and geolocation settings for child users – this refers to services’ implementation of default settings for child users, to mitigate risks of harm. Under the ICO’s Children’s code settings must be high privacy by default and geolocation options must be switched off by default unless a service demonstrates a compelling reason for a different setting, taking account of the best interests of the child. 5️⃣😎Online safety privacy duties – this refers to the duty imposed by the OSA for services to have regard to the importance of protecting users from a breach of any statutory provision or rule of law concerning privacy when deciding on safety measures and policies. 6️⃣📖Upholding terms, policies and community standards –the OSA requires services to publish clear and accessible terms of service. The ICO Children’s code requires services to uphold their published terms, policies and community standards (including but not limited to privacy policies, age restriction, behaviour rules and content policies). 👇🏻 See more here 👇🏻

📲 Data Protection Reform in the UK Data protection law is in a constant state of flux globally, driven by new guidance, cases, enforcement action, and emerging technologies (hello, generative AI!). The UK is no exception, especially post-Brexit. The journey began with the Data Protection and Digital Information Bill under Boris Johnson. It evolved through various stages and names, finally becoming the Data Protection and Digital Information Bill 2023. Despite much anticipation, progress stalled. There was hope it would pass before the summer recess, but... On 22 May, Rishi Sunak called for an election on 4 July. By 23 May, it was clear the Bill wouldn’t be part of the government's ‘wash-up’ session, leaving commentators to declare it “dead” for now. What’s next? If Labour wins, they might not prioritise data protection reform. However, there's a rumour of potential Labour-led reform this Autumn, which could also address AI. Stay tuned!
