Do sustainability and/or ethics actually matter to consumers? Judging by the thread I have recently been following on a private FB group the answer is no. New launch of M&S capsule collection for/inspired by the England football teams. The PR makes no mention of fabric, sustainability or similar. The original poster of the thread asks for comments on the collection. I commented that bearing in mind M&S have a whopping great sustainability policy but make no mention of sustainability in the PR speaks volumes. Were the clothes to have an ounce of sustainability in their content or production you can bet it would be all over that PR. In our sustainability bubble we (or at least I) am obsessed with the fabric, where the item was made, how will it be disposed of. But out in the world of pretty things and cheap clothes sustainability is really not that important. People (and clearly M&S) don't care. The CMA’s new anti-greenwash guidance in the UK is a welcome step to help drive greater compliance across fashion brands and retailers and root out misleading green claims. It’s indicative of the broader shift we’re seeing in the fashion industry, with sustainability becoming an operational imperative, rather than the voluntary, passion-driven cause of previous years. The fast-changing regulatory landscape that brands, retailers and manufacturers are having to navigate is complex – so guidance such as this, and support from organizations like Cascale, is vital to help companies comply with this new dawn of regulation. However, while we should applaud progress, this isn’t a moment to pause and pat ourselves on the back. The reality is the fashion industry isn’t doing enough to combat climate change, and compliance is the bare minimum. We must anticipate change and be proactive in improving our businesses for the better of people and the planet – right now. UK COMPETITION AND MARKETS AUTHORITY REMINDS FASHION RETAILERS THAT IT’S NOT SO EASY TO CLAIM YOU’RE GREEN - The UK Competition and Markets Authority (“CMA“) has announced that three fashion retailers have signed voluntary undertakings to ensure that consumers have a clearer idea of how green their clothes really are. At the end of March 2024, ASOS, Boohoo and George at Asda committed to only make green claims about their products that are accurate, clear and not misleading. At the same time, the CMA also published an open letter to the fashion retail sector stressing that players should ensure that all the green claims they make comply with UK consumer protection law. The commitments will be a particularly useful resource to fashion retailers, and businesses more generally, that are considering how to apply the CMA’s Green Claims Code to their products, and gearing up for potentially more potent interventions by the CMA in this space. To this end, it should be noted that the CMA ominously concludes its open letter by noting that its anticipated new powers under the Digital Markets, Competition and Consumers Bill (“DMCC“), which is currently being approved by Parliament, will allow the CMA for the first time, to impose financial penalties for breaches of consumer protection law, such as misleading green claims, without having to go to court.
