HMRC has been issuing ‘nudge letters’ to crypto investors recently from the information it receives from crypto platforms. Individuals are generally subject to CGT on a disposal of cryptoassets (although income tax can apply in some circumstances). Individuals may well be unaware that in exchanging one token for another type, or using them to pay for good or services, they are making chargeable disposals. With around 10% of the UK population estimated to hold some form of cryptoasset, crypto will evidently be a “hot" focus for HMRC in coming years. But, just a thought on losses. How many taxpayers will have made losses (given the volatile nature of crypto) and not thought about claiming those losses? If an individual is due to make a significant gain on other assets, could consideration be given to sell or exchange their crypto if they’re standing at a loss, to mitigate their exposure to CGT? Further, if they’re buying and selling crypto regularly, and make a loss in a tax year, could they be trading and therefore claim those losses against their other income? Cryptocurrency is a high-risk, high-reward investment and anyone that is investing should be thinking seriously about the affect it can have on their overall tax position.

The #HMRC consider the #Usufruct, as another British law right, a life interest trust, making a fiction that it is not legally binding but if the client does not act, he will have to pay between 10% to 40% of Uk inheritance Tax from the Spanish property plus penalties.

A Post Transaction Valuation Check (PTVC) can be requested from HMRC for an individual to work out a capital gains tax liability or for companies to calculate corporation tax liability on chargeable gains. The request for a PTVC should be made using the CG34 form. HMRC’s guidance says the form must be completed and sent to the address on the form at least three months before the relevant tax return filing date. #HMRCValuations #Tax
