Today RIA and Civil Engineering Contractors Association (National) hosted a Preparing for Procurement Reform Briefing, detailing the ways in which procurement will change in England and Wales from 24 February 2025 and how suppliers can best prepare. CITB, in response to the proposed Growth and Skills Levy announced in the King’s Speech, has said it is ready to work with the government, industry, and training providers to ensure sustained growth in construction. “Key to achieving the government’s housebuilding targets is to get the right skills policies in place. It is essential the new Growth and Skills Levy drives up construction apprenticeship numbers that have declined under the Apprenticeship Levy," said Tim Balcon, CITB CEO. “We simply do not have enough workers in the construction industry right now – in 2023 there was a net loss of 10,000 construction workers. Our research shows that under Labour’s housebuilding plans, up to an additional 152,000 workers will need to be found. “Last year CITB helped over 29,000 apprentices during their courses. NEC4: Accepted Programme and unimplemented compensation events. I’ve read a few posts and comments recently on this topic. Other than a bit of confusion around NEC2, which I won’t muddy the waters with here, I think it’s clear. NEC4 includes the concept of the ‘dividing date’. This should alleviate concerns PMs may have about accepting a programme that shows the effects of unimplemented CEs on planned Completion. There are I think two areas to hold in mind. 1. A programme submitted for accepted must - show timing of operations in order to Provide the Works (31.2), - represent the Contractor’s plans realistically (31.3) and - show actual progress achieved and its effect upon the timing of the remaining work (32.1). 2. A CE is implemented upon acceptance / treated acceptance of a quotation, or an assessment by PM (66.1). When implemented, the Completion Date and the Key Dates are changed accordingly (66.2). From 1. it is clear planned Completion must always include the effects of real events. Let’s be specific - we mean the effects of the instruction changing the Scope, the instruction to stop, delay caused by physical conditions, weather etc. To leave their effects out would be unrealistic or to not show how the Contractor plans to Provide the Works. From 2) we know the Completion Date does not move later due to a CE until it is implemented. When the PM accepts a programme showing events related to unimplemented CEs, they are not somehow ‘leapfrogging’ the CE procedure. A delay to the Completion Date for a particular CE is assessed on the Accepted Programme current at the dividing date (63.5). The assessment is included in the quotation for the CE (62.2). Also, don’t forget PM assesses the CE if, when quotations are submitted, the PM has not accepted the latest programme for one of the reasons stated in the contract (64.1). One thing contractors might consider - annotating activities as CEs, particularly before they are implemented, can cause the PM to hesitate in accepting a programme. Once the CE is implemented, the subsequent programme submitted for acceptance will show the revised Completion Date as having moved. In the meantime it is possible planned Completion will have overtaken the Completion Date. X7 is worth a read too. Note how delay damages are only paid for each day from the Completion Date until Completion. They are repaid if the Completion Date is subsequently pushed back e.g. for implemented CEs. As always just my musings and not advice, but perhaps a useful conversation starter.

The builders' merchants sector, like the construction industry overall, has a recruitment challenge. However, the Construction Industry Training Board estimates that 225,000 workers will be needed by 2027 to meet industry demand, meaning action is needed urgently. MKM believes that all apprentices deserve the job security that a permanent contract of employment provides. MKM only brings in an apprentice to fill a gap in its business where there is a long-term vacancy, not just a role that could last 18 months.
