IP POLICY: In November 2024, World Intellectual Property Organisation (WIPO) members approved the Riyadh Design Law Treaty, which simplifies the process of protecting product designs worldwide. Key changes to the existing treaty include the introduction of a 12-month grace period, clearer rules for the content of design applications, and furthering the introduction of an electronic filing system and electronic exchange of priority documents. A further benefit is the option to delay publication for at least six months after securing a filing date. The treaty will take effect once the first 15 contracting states ratify it. These are encouraging developments. In particular, app designers and other innovators in the software area will welcome the clarity around design applications, given that so many US patents in company portfolios are in reality design patents (called “design rights” in Europe). IN THE NEWS: In November, an article in IAM reported that GoPro, the maker of high-definition personal cameras and video editing software, sold 114 patents relating to unmanned aerial vehicles (UAVs), content capture, data processing, hardware and vehicle guidance to drone company Skydio Inc. earlier in the autumn. GoPro has been struggling financially, with a $75M operating loss in 2023 and plans announced in one of its 2024 SEC filings to lay off a quarter of its workforce, so divesting these patents comes in the context of an updated restructuring plan. GoPro’s situation helps demonstrate the benefit that companies can derive from building up a portfolio of high-quality patents, in this case giving it assets that can be monetised in time of need. But even companies that are financially strong may benefit from reviewing their portfolios to identify patents that are no longer central to their business and that may offer opportunities for assignment (sale) or licensing. In doing so, they can not only monetise unneeded assets but also save the cost of maintaining them each year. Trusted Technology Network (TTN) is delighted to announce the expansion of its European team of experienced IP strategists to include Maria Fotaki and Nigel Clarke. Maria began her career at the European Patent Office (EPO) as a patent examiner in biotechnology, specialising in gene therapy and viral vectors. She later became a director, improving examination procedures and developing bio-tech specialised IT tools for nucleic acid sequence analysis before enhancing the EPO’s customer relations procedure for analysis, response and internal action in response to users’ feedback. Before the EPO, Maria earned a PhD in medical biochemistry and worked at the Neuroscience Research Institute of Montreal General Hospital and carried out gene therapy research for Alzheimer’s disease at Hoffman LaRoche in Basel. Nigel Clarke started at the EPO as a patent examiner in electron and ion optics, later moving into IT project management, procurement and training. He then led projects on international cooperation with EPO contracting states, marketing and promotion of patent analytics. Finishing his career as Head of Patent Analytics, he launched the Future and Emerging Technology Analysis (FETA) project and promoted EPO services globally. Before the EPO, Nigel was a UK government scientist in nuclear energy and defence. He holds a first-class degree in physical chemistry and a PhD in neutron science from the University of Exeter. IN THE NEWS: In October IAM published an article entitled ”IBM and Amazon seek changes to USPTO’s Section 101 guidance for artificial intelligence”, which reported the companies’ feedback on the US Patent and Trademark Office’s Section 101 guidance for AI patents. While both companies welcomed some aspects of this, IBM suggested that the USPTO should provide further guidance for examiners who consider “mental processes for patent eligibility purposes”. Meanwhile Amazon raised a number of concerns, including that certain examples outlined in the guidance could potentially hinder innovation and lead to invalid patents. Just as AI tech development is currently a hugely vibrant and fast-moving area, so the IP environment is having to evolve quickly in response. Interventions such as these show that this is not just a case of the leading patent offices taking decisions as to how to treat AI-related IP, but also developers and practitioners having their say as to what needs to happen. How this will ultimately play out in terms of guidelines and patenting procedures is yet to be seen, but we can be sure that it will develop significantly in the coming months and years. INDUSTRY INSIGHTS: On October 11, OpenAI published a blog post (https://lnkd.in/epqgy4fX) outlining its defensive approach to patent rights. In doing so, it emphasises its commitment to broad access and collaboration in AI, stating: “We pledge to only use our patents defensively, so long as a party does not threaten or assert a claim, initiate a proceeding, help someone else in such activities against us, or engage in activities that harm us or our users.” One of the things that is striking about this is that when OpenAI started out as a not-for-profit business, it thought that it did not need patents. Now, as a for-profit (and with Microsoft as a 49% shareholder) it has ultimately decided that it does, albeit only for defensive purposes. It may be that all successful software companies should consider the possibility of establishing a blended IP strategy that combines open source and patenting. Doing so need not compromise principles about the availability of technology, since a company can choose whether and how to enforce its patents; but it will at least ensure that the founders have ways to defend themselves – and their principles – if others seek to abuse them. TTN Insights: In May 2024, Trusted Technology Network (TTN) published an article addressing the "Seven Challenges of Patenting Artificial Intelligence” on its Insights page (https://lnkd.in/ey3q8xvQ). The fifth challenge is the "inventive step”, regarding the obviousness of the invention. The criterion that patent examiners use is whether a skilled person (i.e. someone who is knowledgeable in the field) would have been able to come up with the invention after having viewed the documents in the search report without needing to use inventive skill, imagination or creativity. Inventiveness or “inventive step” is a requirement in all patent applications. However, AI has the potential to affect this: if a skilled person uses AI as a standard tool, a possible consequence would be to raise the threshold of inventive step, meaning that patent examiners would look for a more substantial inventive contribution – a potentially significant impact.
