Following our call for the MSC legislation to be scrapped, HMRC has now issued some new guidance. The purpose of the legislation was to prevent workers operating and benefiting from using a limited company when they were responsible for making their own IR35 assessments which was driven by HMRC’s inability to enforce the rules. This all changed with the introduction of Off-Payroll Working that, in the majority of cases, moves this responsibility to the end client. The issue with MSC is it is almost impossible for a worker to assess and the high-level overview provided by this guidance does not provide enough of the fine detail, and as we know the devil is always in the detail.
